Signed a contract to build a house May 2021 and gave them $202,500. It was to be completed April 15, 2022. They did nothing until March 2022. Since then they extended the contract several times. The last extension on October 29th stated "buyer and seller agree to close on or before December 9th." I was informed on November 9th they were going on vacation. In November and December I requested the material price increases to review. On December 23rd I was provided with the incorrect information. There was a big storm that day and there was a lot of damage to the property. I do not agree with them that the house is complete because the driveway is not finished and is one reason for a lot of the damage because the drains are not working. In early January I offered to close and they lied to me about the retaining walls being fixed ( went up there to check). There are a lot things to be fixed but I was told to close or they would sell the house and I would get back money depending on how much it sells for. There is a TIME IS OF THE ESSENCE clause which has been egregiously violated and there is a clause about $20000 worth of damage before closing. I want my money back based on the TIME IS OF THE ESSENCE clause which they continue to ignore. There is a shortage of houses and the prices have gone up a lot since May 2021. This is a good deal for them. I just want my money back and get them out of my life. It's going on 2 years and this house is a mess. They breached the contract as of December 9th. It's their fault the yard is a mess as it was left with no erosion protection. It's their fault the driveway wasn't finished and caused other damage. All of this damage I would have had to pay for if I had closed on December 9th. Also I believe the driveway is built incorrectly because the water from the roof will run down the side of the house instead of going in the drains. They also owe me $900 for fans etc. I bought or they can return them to me.
