    **** Reilly took money from us for materials and labor for the construction of our home. He did not purchase the materials or provide labor for approximately $75,000 worth of materials and/or labor. The work he did provide was so poorly done that we have had to pay another contractor to redo most of the work completed by Dave Reilly Construction, LLC and his subcontractor, *************************. We want our $75,000 returned since he did not do the work or purchase the materials as was promised.

    I am writing to provide a detailed account of the events and the resulting financial impact caused by **** and **** ****** on my company, Dave Reilly Construction, LLC. The following points outline the key issues and the associated costs incurred during the construction of a custom home for the ****** family on their land in ********, **:

    Initial Contact: **** and **** ****** approached my company to build a custom home, providing only a conceptual drawing and a budget based on a previous contractor's estimate.

    Agreement Terms: I agreed to build the home at their quoted price under the condition that it would be constructed with Insulated Concrete Forms (ICF) and according to my company's Standard Home ***************************************contract, the ****** revealed an interior floor plan that exceeded the original budget, but they refused to cover the additional costs.

    Commute and Labor: I traveled 98 miles round-trip daily for construction, incurring over ****** miles on my truck and significant fuel costs, alongside paying for additional labor.

    Inflation and Over-Budget Purchases: Despite inflation affecting material and fuel prices, I did not pass these costs to the ******, who also made over-budget selections without intending to cover the overruns.

    Material Delivery Delays: Road postings led to delivery delays, and I pre-ordered ICF blocks at an additional cost of $13,000, for which I was not compensated.

    Construction Progress: My company completed significant work, including site excavation, foundation work, and wall construction, without full compensation for labor and equipment.

    Financial Losses: I have incurred substantial financial losses due to equipment rental costs, material overruns, and uncompensated labor, totaling well over the $75,000 claim made by the ******.

    Equipment Sale and Loans: To continue the project, I sold equipment at a loss and took out high-interest loans, yet the ****** ceased payments in December 2022.

    Harassment and Work Termination: ************************* harassment and unsafe work conditions led to the project's termination.

    In conclusion, the claim that my company owes the ****** $75,000 is unfounded, as they have not covered the actual costs incurred. My company has suffered significant financial losses while attempting to fulfill the contract in good faith.

    I are writing in response to the ongoing complaint filed by **** and **** ******, identified by Complaint ID #********. After thorough review and consideration of the allegations and subsequent communications, we firmly believe that the refutations presented against our company are baseless.

    It is essential to clarify that we hold the BBB in high regard as a platform for resolution and transparency. However, it is also crucial to understand that the BBB serves a different function from a court of law. The complaint at hand has evolved into an unproductive back-and-forth that deviates from the BBBs purpose of fostering understanding and resolution between parties.

    Our records indicate a clear breach of contract initiated by **** and **** ******, evidenced by their unilateral decision to terminate our agreement. This action was formalized through a termination letter sent to us, which resulted in our team being unjustly removed from the project site. Given these circumstances, it became logistically impossible for us to fulfill our contractual obligations or complete the work as originally planned.

    We consider the request lodged by **** and **** ****** to be both unreasonable and infeasible under the circumstances they themselves have created. Pursuing this matter further seems neither constructive nor in alignment with the principles of fairness and good faith.

    In light of the above, we respectfully request that the Better Business Bureau consider this matter thoroughly, recognizing the limitations imposed on us by **** and ************************* actions. We suggest discontinuing this chain of conversation, as it appears we have reached an impasse with the client that cannot be resolved through further dialogue.

This correspondence rebuts their claims, clarifies the factual context, and issues a cease and desist directive regarding the dissemination of unfounded information about our firm.

    It merits emphasis that our team has committed extensive labor and resources to the ****** project, which surpasses the financial recompense received. In spite of these endeavors, **** and **** ****** have opted to elevate this issue to the public sphere, notably through an unseemly confrontation by **** ****** in a communal parking area. This conduct is not only disconcerting but also reveals a deliberate attempt to tarnish our company's reputation by any means necessary, including exploiting the Better Business Bureau (BBB).

    The assertion of our failure to meet contractual obligations is categorically untrue. Our documentation unequivocally demonstrates persistent efforts to engage and rectify any concerns, notwithstanding the confrontational demands and the unwarranted cessation of our contract by the ******. This premature termination has thwarted our ability to conclude the project, inflicting considerable financial detriment upon our company.

    We have substantial grounds to believe that **** and **** ****** are engaging in a concerted effort to malign our company's standing. Such endeavors are not only injurious but might culminate in legal ramifications pertaining to defamation. This letter constitutes a formal warning for **** and **** ****** to desist from propagating baseless allegations about Dave Reilly Construction, LLC, and from utilizing the BBB or any platforms to illegitimately solicit funds from our firm.

    We unequivocally reject any demands for reimbursement to **** and **** ******, given that the provisions of services and materials to them far exceed the remuneration accorded to us. The persistent dispute has been demonstrably fruitless, and we assert that continued negotiations under these adversarial conditions are improbable to ****** any constructive resolution.

    In the event of persistent derogatory actions, we are poised to initiate legal proceedings to safeguard our reputation and enterprise. We advocate for a resolution that circumvents further discord, imploring **** and **** ****** to halt this unwarranted conflict.

    We appreciate the BBB's attention to this intricate matter. This response aims to clarify our firm stance: no refunds will be issued to **** and **** ******.     Dave Reilly was hired in 2023 to restore the cottage on my property, in, Bethlehem, NH and also do work on my house also on the property. Less than ¼ of the work I paid him in full for has been completed. Since July of 2023, I have been chasing Dave Reilly to finish up the work. I have spent 6 months waiting patiently for him to fullfill his promises to me. He has given me in this time about 1 weeks of work from his contractors. The last time he has spoken to me is August 2023. He has ignored my emails and my texts pleaing with him to finish the work I hired him to do. I am a senior who just recently lost her job in December. I told Dave multiple times that I needed the cottage renovated so I could have supplemental income and that I was going to lose my job. No response.
    This has been a devastating emotional and financial loss to me. The money I gave Dave Reilly was money I inherited from taking care of my mom. To have this money now in the hands of Dave Reilly is heartwrenching.. After months of waiting patiently for Dave to contact me I finally have had to come to conclusion that I have been taken advantage of and lied to. Here is my documentation as well as the contracts and copies of the checks. A report has been filed with the Attorney General’s office and the Bethlehem NH police department and I am in the process of hiring a lawyer to help me get my money back.
