Contracted ***************** Flooring to do a modification to our first floor bathroom for my Disabled Husband. Gave a deposit of $4450.00 (50% of quote) to begin work 2/19/2024. Contractor contacted me the Friday before work was to begin and told me he was injured and could not complete the work but would return my deposit. I gave the contractor a few weeks and still have not received my deposit. I asked the contractor why my deposit was not in an escrow account and he told me he used it to run the business and pay his help.

    Business Response

    Date: 04/05/2024

I injured myself at work, doing work I should not have been doing, because my employee didn't show up for work. I reached out to customer and explained my situation, and have stayed in contact with her regularly. I'm trying to get back to work now. She is on my mind everyday!! This has never happened before and will never happen again. As soon as I get back to work, I will return her deposit with interest. Truly a nightmare for my customer and me. And I'm truly sorry!!

    Complaint: ********

I do not accept the business's response as a resolution to my complaint because: See attached email - I am not satisfied with the response for 2 reasons: 1) In ******* response he does not state WHEN he will return my deposit, only that he will pay it back with interest, I am not interested in interest. 2) In ****'s email to me in February, he said he was relocating to ******** in ****** It's ****** If he is indeed in ******** now, it will make it more difficult to retrieve my deposit.

I have already lost a contractor due to the fact that I did not have my deposit returned to retain the contractor. I have another contractor that I want to retain and I need my money to place a deposit.

IF BBB does not want to pursue further, I intend to bring it to small claims court.

    Sincerely,
