    We contracted Phoenix Contracting, Inc to build a swimming pool as described on the attachment in our backyard. We made our deposit per the contract. "(NOTE: If the contact is cancelled for any reason there will be $350. Minimum charge)"-the company stopped responding and then refunded our contract absent the $350. They performed NO work. They did this to other people as well. They cannot reasonably expect their default to the contract and not performing work authorizes them to keep $350. The action is fraudulent and if contractually enforceable then any company could offer a service default intentionally and make $350 for no services given. A full refund of the $350 is what is being requested.

    **** ******** signed a contract and provided a $2,450 deposit. The contract clearly stated that if the contract is cancelled for any reason, there will be a $350 minimum charge. That $350 covered the cost of time for 2 people and fuel for the site visit. I had returned deposits to more than 6 customers during the course of the year due to health issues. In all cases, the $350 was withheld as site visits were performed and considered work time.
