    I gave Dale Wetherby a deposit of $4,000.00 to level my mobile home back in August 2022. I have attached a copy of the cleared check and the invoice which also served as the contract. Dale had some medical issues and was in the hospital in October 2022 and then it became too late in the season for the work. He assured me I was to be first in line in the Spring. I reached out to him on April 20, 2023 and got no response. I texted him again on May 1, 2023 and then tried his office phone and the message was that the number was no longer in service. I received a reply of "And who is this" on May 3rd. That was it. Then on May 15th and 16th I texted him again and told him if he didn't get back to me I would assume he would not be doing the job and how disappointed I was. I did not think he was this type of person. That prompted a reply from him, telling me to never talk to him like that. He was going through some medical problems and he would have no problem just giving my money back. On May 17th he texted me that he would call me the first day he got out of the hospital. Then he asked if I would call him the next night. We spoke on the phone on May 18th and he explained that he was doing better and that he was going to bring his Dad out to take a look at the house because it was a big and complicated project and his Dad had many years of experience doing this. He told me not to worry and I told him that I do worry when I don't hear from him. It was a good conversation. I waited and finally on August 3rd I texted him that I was checking in. No response. I finally had enough and texted him on August 15, 2023 asking him to return my deposit. I stated that he had been unresponsive and at this point I had to move on. I have had no response. August 28th I sent a certified letter which was returned. September 11th I sent a copy of the original letter and another letter giving him until Oct. 11th to return my money or I would go to the BBB and others.

    The company has not reached out to me either. I have pursued action through the small claims court system.
