Mr. ********************** was hired to represent me on an insurance claim on my property . He agreed to handle ALL aspects of this claim and re**up the money needed to repair my house . Mr ********************** failed and refused to do his job . He refused to negotiate with the Insurance **mpany and the **ntractors . He told me to do his job. I had no choice but to do so despite his **ntract. I **llected approximately $12000 less $1000 deductible from my insurance ** before I hired Mr ********************** . I dealt with the **ntractors as Mr ********************** refused . I have proof in writing . I had to track down the **rrect Insurance **mpany as he refused. So My insurance **mpany came out and issued an estimate and check for approximately $35,000 . They sent the check to Mr ********************** who cashed the check and took 25% of the total amount of settlement . This includes the $12,000 I received prior to hiring him . Mr ********************** also took 25% of the depreciation the Insurance **mpany deducted . When I called Mr ********************** he threatened me and my family . He then told me to call his lawyer who also refused to return calls and e-mails . After a few weeks Mr ********************** e-mailed me with lies . I just do not want this criminal to do this to any other innocent homeowner . He took $ ****** from me but alos **st me at least$30,000 with his failures and refusal to do his job . I just want my $11.400 back

    Business Response

    Dear BBB,

************************* complaint is simply untrue. I have an attorney handling this case and if ****************** chooses to file suit, my attorney has full authority to file a countersuit against him for the damages he caused me by his breach of contract. ****************** has received substantially more in services than he paid me. He used my work product to negotiate for a secondary settlement from a third party insurer. ****************** should have his attorney contact my attorney or simply file suit and the courts will settle the matter. If you would like the name and address of my attorney, please let me know.

    Respectfully,

    James E. Fifth

I am rejecting this response because: Mr. ********************** simply refused and failed to do his job as agreed. He makes up his own set of facts to suit his agenda . He knows he did not earn a dime . He cost me thousands . He knows he did not negotiate or investigate my claim . I had to do his job for him . He and his lawyer refuse to return calls or e-mails . He made me deal with the contractors and Insurance company. I had to find the liable carrier . I had $80,000 in damages Mr. ********************** collected ****** and kept $11,372. . This is well in excess of the contract and he knows it . He took 6 weeks to write an estimate which was ignored and laughed at by all the insurance carriers. I will be happy to meet with the representatives at the BBB with Mr ********************** present and we can disclose all the facts and I can assure you the BBB would find Mr. ********************** guilty of breach of contract . I also know Mr ********************** would not show for such a meeting as is this is his way of doing business. I estimate he may have works 2-3 hours at most and took $11,300 while costing me thousands . As for Mr ********************** and his threats to *** me I can assure the ** if he had  a case he would do it . Please do not let this so called public adjuster do this to any other innocent parties .

    Regards,
