    On March 5th of 2020 I signed my daughter up for the spring session of gymnastics at CS Gymnastics, and paid the $297.00 tuition fee in full. About a week later, everything shut down because of covid and CS Gymnastics was not offering classes any longer. On September 7, 2022 I spoke with a ******* regarding a refund for the tuition I had paid for the spring 2020 session, but my daughter was never able to attend. ******* was unsure of the procedure for getting a refund, but would speak with her manager, the owner of CS Gymnastics, according to her and get back to me. Shortly after, she left me a voice-mail stating that I needed to submit the request in writing, via email, and they would "take care of it", presumably meaning they would process a refund. On September 8, 2022 I sent the first written request. Finally on September 20, 2022, after another email request, and several unreturned phone calls, I received and email stating no refunds would be given, and was sent a document CS Gymnastics alledges i signed in September of 2019, 6 months prior to when i actually signed my daughter up for the spring session. This completely contradicts the recorded voice mail I have from ******* stating they would give the refund after I provided a written request via email. If CS Gymnastics had no intention of providing a refund, I should have been told that from he start. Instead, I was told to write an email requesting one, and they would take care of it.

    Tell us To whom it may concern:

    This customer initially enrolled her child in class at C.S. gymnastics for the Fall Session of September 2019, and opted to renew her childs enrollment for the subsequent Winter and Spring Sessions this information along with her initialed signatures and dates of enrollment for each session can be found on the enrollment forms which were sent to her via email on September 20th 2022 in response to her request for refund. This is why the initial date of enrollment and the start date of the Spring Session are several months apart. The enrollment forms that the customer signed at that time (under previous business Ownership) clearly state in two separate sections There are no refunds. While C.S. is under no contractual obligation to do so, we are sympathetic to the unique situation and therefore opted to honor the credit on the account without expiration. That credit can be used towards any of the programs we offer including classes, parties, clinics, camps, parents night out, etc. This information was also included in the response email. At no time was a refund promised verbally or in writing. why here...

    I am rejecting this response because:
      I have a voice-mail recording stating I will be given a refund. Also, my daughter was signed up on 10/10/19 for the fall session, as indicated on the first page of the paperwork the business sent me. The signature on the second page of that paperwork is dated 9/10/19. A whole month before I actually signed my daughter up. That's really irrelevant, however, because contrary to the business' claims, I have a voice-mail stating I would be given a refund, and explicit directions on what I need to do to get the refund. I'm not the party that decided to not have my daughter attend classes. The business stopped offering classes all together, they breached the contract by not providing the service I paid for, and as such should honor their word to provide a refund.
