      On November 2024, I signed a contract with J.E. Mowery Septic for a septic system installation and paid an initial deposit of $21,950 after being assured by their representative, Lee, that work would be completed promptly, even through winter. However, despite multiple follow-ups, the company repeatedly delayed the project, providing various excuses while failing to begin work.

      In March 2025, they finally started minimal work, digging in the front yard for the leach field. However, they then demanded a second deposit of $10,987.50, threatening to remove their crew if payment was not made. In response, I required Lee to sign an agreement stating that upon receipt of the second deposit, they would complete all work, including:

      Excavating the disposal field

      Installing a 1,500-gallon, two-compartment septic tank

      Properly abandoning the seepage pits

      Backfilling, grading, fertilizing, and seeding

      the project remains incomplete. Everyday there is a new excuse as to why they arent moving forward. Meanwhile, our septic system is failing, and our ability to sell our home has been compromised, causing us to incur additional costs exceeding $7,500 per month.

      J.E. Mowery Septic’s conduct demonstrates bad faith, breach of contract, and potential fraud, as they took substantial payments without completing the agreed-upon work within a reasonable timeframe. Their continued delays and lack of accountability have placed us in financial hardship.

      We are hoping for

      Immediate completion of the septic installation as per the signed agreement.

      A full or partial refund for the incomplete work and financial losses incurred due to their delays.

      Any other legal action deemed necessary to prevent further harm to consumers.
