      We are in receipt of the referenced complaint and appreciate the opportunity to resolve the consumers concern.  Below is a summary of the account activity. 

      On 02/08/2021 ************************* entered into a gym membership agreement with our client, Anytime Fitness - Watertown.

      The contract went into default for non-payment and Anytime Fitness - Watertown (the Gym) subsequently assigned the account to ********************** (FCS) for collections on 06/01/2023.  Collection efforts began with the sending of the Model of Validation Notice on 06/05/2023 informing the consumer that the account was placed with our office for collections.

      Upon receipt of the complaint the account was placed in a disputed status. Prior to the complaint we have had no verbal or written communication from the consumer requesting validation of the debt.

      We reached out to the Gym in order to address their concerns and obtain assistance in resolving their complaint.  However, they did not provide full documentation of the debt.  Any inquiries regarding the account should be directed to the Gym as our office is no longer handling the reference account.

      Upon closure of this account a request was submitted to the credit reporting agency to delete the tradeline.  Be advised that credit reporting agencies can take up to 30 days or longer to update the report, and this is beyond our control.

      If you or the consumer have any questions or concerns our Compliance officer is available Monday through Friday 9am to 6pm EST at **********************.

      We are in receipt of the referenced complaint and appreciate the opportunity to resolve the consumers concern. Below is a summary of the account activity.  Prior to the receipt of this complaint, we have had no written communication from the consumer. 
      On 07/10/2022 ***************************** entered into a gym membership with our client, ********************** Martinsburg, **.
      The contract went into default for non-payment and ********************** Martinsburg, ** (the Gym) subsequently assigned the account to ********************** (FCS) for collections on 11/28/2022.  Collection efforts began with the sending of the Model Validation Notice on 12/01/2022 informing him that the account was placed with our office for collections.
      On 07/12/2023 our office contacted ******************** and during the call he did not dispute the balance nor requested validation of the debt. ******************** asked if we would provide him with a pay to delete letter.  He was informed the tradeline would reflect the terms of the payment as we do not engage in pay to deleteactivity. 
      Upon receipt of the complaint, we contacted the Gym to address the concerns raised and assist us in resolving ********************** complaint.  The Gym has recalled the account.  Accordingly, we have ceased collections of this account and returned it to our client.  Any questions he may have concerning the account should be directed to the Gym. 
      We have directed TransUnion to delete the tradeline and submitted an AUD (control # *******).  Be advised that credit reporting agencies can take up to 30 days or longer to update the report, and this is beyond our control.

      entered into a gym membership with our client, **** ******** *******

      default for non-payment and **** ******** ******* (the “Gym”) subsequently
      assigned the account to First Credit Services (“FCS”) for collections 01/27/22.
      Collection efforts began with the sending of the Model of Validation Notice on 01/31/22
      informing him that the account was placed with our office for collections.
      Upon receipt of the
      complaint, the account was marked to cease collections activity and the account
      was updated to a disputed status.  We
      contacted the Gym to provide verification. 
      In response to the complaint, we enclose the following documents to
      serve as account validation: 1.) Membership Agreement, and 2.) billing history.
      We
      took additional steps to review the credit reporting activity, and based on our
      investigation, the account and the following credit reporting activity are
      accurate.

      We are in receipt of the referenced complaint and appreciate the opportunity to resolve the consumers concern.  Below is a summary of the account activity.  Prior to the receipt of this complaint, we have had no written communication from the consumer. 

      On 09/30/2022 ************************* entered into a gym membership agreement with our client, Crunch *******, **.

      The contract went into default for non-payment and Crunch *******, ** subsequently assigned the account to ********************** (FCS) for collections 02/27/2023.  Collection efforts began with the sending of the Model Validation Notice on 03/02/2023 informing him that the account was placed with our office for collections.

      On 05/08/2023 ************** contacted our office and asked if he paid the balance would it get deleted from his credit report.  The Agent informed ************** the tradeline would reflect the terms of the payment as we do not engage in pay to delete activity.  ************** stated he would call back as he would need to do further research.  At no point did ************** request validation of the debt.

      Upon receipt of the complaint, the account was marked to cease collections activity and the account was updated to a disputed status. We also contacted the Gym to provide verification.  The client has recalled the account from placement.   Accordingly, we have ceased collection of this account and returned it to our client. Any questions concerning the account should be directed to the Gym.

      I am rejecting this response because: this company has placed a collection for $100 on my credit report from a supposedly gym membership of crunch fitness.  I need a wet signed document stemming from a contract that they allegedly state that I owe.  My rights as a consumer is being violated and I have also placed this with CFPB.
