Mr. and ***************** live in a community that is a wooded area with deer, fox, stray cats, raccoons and squirrels.  The have video cameras on their house and have seen fox and stray cats in their garden.  *************** cannot address roaming animals who choose their garden to use.  *************** has Rules and Regulations that address curbing the dog, but people who do not live in the community walk their dog in the community and allow the dog to defecate.  When any owner complains about an owner not curbing their dog either a mass email to the community is sent reminding everyone to curb their dog with the ************ ordinance or  when a specific owner is addressed, the owner receives a courtesy violation notice.

In the spring 2023, the Sheperds emailed about removing the mulch in the garden area.  The garden area is common property and the Association did not want to spend Association funds on one owner who did not want mulch.  If the owner wanted to pay the landscaper to remove the mulch, then the Association approved the removal.  First, the Shepherd's wanted the mulch removed then after no animals were roaming around their house for about a month, they wanted to leave the mulch.

The landscaper knocked off their downspout elbow in the spring while mulching the garden bed.  It was replaced.  The downspout was knocked off again in early December and the Shepherd's sent a picture that the downspout was knocked off again.  I sent the picture to the landscaper and his response was that the downspout elbow needs to be tacked to the downspout.  His crews left for the day, but he returned the following week when he was in the area and replaced the downspout.

All of the Shepherd's needs have been met on a timely basis.  Their disputed amount of two years x $185/month = $4,536 is unrealistic because they have received all landscaping services that are provided and contribute to a reserve fund.  An ivy that grew up the side of their house was removed.

ON December 7, 2023, the Board held an executive meeting and invited ****. *********************** from the ************ Police to discuss the harrassing behavior from ******************** to two Board members who live next door to him.  ********* member is 80 years old and listens to four hours of loud music on a consistent basis.  She cannot leave her home without ************************ alarm system sounding.  She cannot get her mail without a screaching noises.  He played ***********************************' " I have a dream speech" on his patio with the speaker pointed at her house.  On December 15, we held an ADR meeting for three late fees that he refused to pay with ********************** attorney and for an hour, ************** kept saying, **** ********* ********************* please let me speak."  ********************* rules in favor of the Association for payment of the late fees, but ******************** has not paid the fees.  .

This weekend I will take a picture of the repaired downspout and compete the minutes of the executive meeting and forward them to you.
