    I am rejecting this response because:

    I paid Strickland Contracting $10,500 (See Exhibit G) for a job that wasn’t completed. I couldn’t be onsite because I was travelling between Arizona where I lived, Utah where my mother was dying and New Mexico where I was trying to get my land site prepped for my retirement.  

    When I was told my representative would finish it by hand, I assumed Strickland meant spreading the gravel around. There is no way a human being could “Hand Grade” a 20-foot driveway and 15 feet by 50-foot homesite pad that would require 2-3 truckloads of gravel that I already paid Strickland for and is included in the amount quoted to me by Strickland (See Exhibits E, G).

    After my mother passed in mid-November (1 month, not 6 months. See Exhibit H, H2, H3. Text message dated 11/29/22 and photos of incomplete work) I returned here to find that virtually nothing had been completed on my sister’s site that was included in the amount of $10,500 that I already paid to Strickland Contracting. I contacted Daniel Strickland and he told me it was raining and he couldn’t finish it, but that he would make it right when I moved here permanently in the spring (See Exhibit’s K, L, M).

    I also do not believe I received $3,200 worth of gravel (6 - 18 Ton Loads) and what I did receive had asphalt chunks mixed throughout the area where gravel was placed (See Exhibit S). I have since had pick up the larger chunks as they are bleeding oil into the ground and buy 2 - 18-ton loads of gravel myself ($1000 Exhibit U) just to level out where the other part of the jobs was incomplete and pay $300.00 to have my existing cabin raised and leveled because the grading wasn’t level and neither was the gravel pad that was made for the cabin to be moved onto (see Exhibits T, T2).

    I should not have been charged $10,500 dollars for an incomplete job if they were going to hand off 30% of the job to my representative to finish, which no human could have done by hand. I should have been notified by the licensed contractor I hired and that accepted the job and took the full amount of money for the work, that my representative was making unrealistic claims about grading such a large area by hand without the equipment necessary to do so and then the amount I paid be 30% less, not the entire $10,500 quoted to me for all of it.

    I invited Mr. Strickland to come and see the work firsthand and he has declined.

    The buildings are needing to be delivered. I have been forced by the inaction of Strickland Contracting LLC to remedy the situation by getting quotes from other contractors to have the work completed. This is not a matter of a “change order request” this was a “complete the job you were paid for request” or refund 30% of what I paid you for the incomplete job you did.

    ned I contacted Strickland and was told that they were swamped and it would be at least a month out and that they would need more money for fuel and mobilization. I disagreed as the fuel surcharge and mobilization charges were already paid for in the breakdown of charges I was sent and he became uncooperative and will not respond to my calls or texts. I called Strickland and spoke to the owner and he said he would try to work something out but also mentioned me paying even more money to them to finish the job I already paid for. I again disagreed that I should have to pay even more money and sent them a short video of what needs to be fixed. Since then they have ghosted me. I have called, left voice messages, sent texts and they will not respond to me. I thought they were an honorable company and it turns out they aren't. Very disappointing! It would be a shame to have to start an investigation through NMRLD or take them to Smalls Claims Court to get this job completed.

    The representative that he had in charge of the project on site  approved the final completion of this project  When owner came to the property 6 month later. He decided there need to be more work done.  In this industry that is called a change order which requires additional funding in which the owner refused, and that’s the current status !

    I am rejecting this response because:

    The response from Strickland Services LLC is unfortunate and does not match up with the documentation I have that they were unable to complete the job due to the rain and upon following up afterwards I was assured they would be back in the spring to make it right.

    Strickland Services is refusing to do the right thing and finish the work they had a verbal agreement with me to complete, or even refund 30% of the $10,500.00 in cash that was paid to Strickland Services for what I was told was a completed job but was at least 30% incomplete.

    I will make other arrangements for the work to be completed so that the buildings can be delivered and I will seek resolution and monetary restitution for this issue through ***** and if necessary, through the courts.
