      My husband ******* ** ****** contacted D1 Landscaping and Outdoor Living, LLC to remove old rock and put new plastic and put the rock back on. But the weeds continue to grow through the plastic and rocks. They told me husband he could not get a refund of what was paid because he signed an agreement. My husband paid 3500 down with an agreement to pay an additional 1450 upon completion.

      I apologize for the inconvenience this has caused **** ******* *** ****** did contact D1 Landscaping for the front yard landscaping. I met with *** ****** on 6/18/2024 and reviewed the contract with him and asked if he had any questions to which he said, 'No'. There is no one employed with D1 by the name of ****** ****** . The morning of 7/29/2024 my crew showed up to get started *** ****** requested to cancel the project. He was reminded of the contract he signed. This contract states the customer forfeits the deposit should the job be canceled. *** ****** still proceeded with his request to cancel the project. My crew did not remove or replace any weed barrier or rock. They did do a one time clean up of the weeds that morning. *** ****** did sign a Request for Cancellation form also stating he forfeits the deposit and all sales are final. With *** ****** cancelling the project, this caused an inconvenience to our schedule. Our schedule fills up and we schedule well in advance. This caused us to scramble to move customers around to fill in that week. Our customers arrange their schedules for their project times. I apologize for the inconvenience, but I stand by our policy. The cancellation of the project was not the choosing of D1 Landscaping and Outdoor Living.

      I have told you several times that my husband's suffers from Alzheimer's has been medicated for this for several years now and I was willing to give you his doctor's phone number, so you leave me no choice I will go to the Las Cruces newspapers and the El Paso News also. 
      You took advantage of 87 years old man.

      PS Also I continue to have to pull your weeds so you will also be getting my bills for your lousy work and injuring my back.

      **** ******* we've never had a conversation, much less about *** *****r may or may not having Alzheimer's disease. I have shared with you the documentation I have in the agreement that was between D1 Landscaping and *** ******* I stand by company policy. D1 Landscaping has no responsibility to your doctor bills. Once again the job was cancelled by *** *******
