    May 28th, MPG found that my HVAC system was inoperable. June 2nd, I received a bid to replace this unit and I submitted it to my insurance co. I inquired with **** of MPG when would MPG replace the unit. She said not until 50% payment was received. I could not wait on the insurance co., so June 12th, I wrote a ck. for $5000 to MPG. I was then told the install would be July1. On June 13th I had realized that I had written a ck. on my business acct., I called MPG and apologized and would replace it with my personal check that day. I was assured that wasn't a problem, they had done the same thing themselves. I was asked had I stopped payment on the business ck., I concurred that I had as I handed her the replacement check. With the extreme heat that we were experiencing, I asked was there a possibility that we could move sooner on this matter. Initially I was told no but then maybe on a weekend. She was to concur with her son who is the tech and let me know. A day went by so I called and asked what was the decision. I was now told the soonest would be July 7. I stated I could not wait that long and could I be free to find someone else. She agreed. June 19th I received an invoice for $10.67 from MPG for a return check fee. My banker informed me that that was a bogus charge as there was no return check, it was clearly a stop payment. MPG did not experience any monetary loss or charge and as explained to me, no transaction had been attempted or performed. I called and inquired only to be met with the most vile, disrespectful response from a subordinate employee, as Lori would not take my call. This person never heard a word from me as she screamed. I finally was able to get a word in edgewise and asked if I could go by and pick up the personal check that I had replaced the business check with and she forcefully said it had already been mailed back to me. She then yelled I would never be able to use MPG again and hung up on me.

    *** ******** complaint about the return check fee is the same that he relayed to me.  The actual facts of the situation are as follows:

    *** ****** brought me a check on June 13, 2025; I deposited the check on that same day.  *** ****** advised the following week that he had stopped payment on that check and was going to re-write me another check on the correct account.  I did advise that I understood as I have multiple checking accounts myself.  He did bring me a replacement check and then subsequently cancelled the order; and I returned the second check to him via mail to *** *******  As I advised to *** ******* when a check THAT WAS ALREADY deposited is stopped by a customer, my bank, as well as his charges a fee.  He argued that it was not a bad check, thus there should have been no return check fee; however as I advised to *** ******* the bank charges the fee when they have to take the money out of the account and RETURN it to the customer.  I advised him that I had already deposited the check, or I WOULD HAVE GIVEN HIM THE CHECK BACK when he brought me the replacement check in.  

    I merely passed on the cost that was levied by my bank for this transaction.  All of this has been previously explained to *** ******

    This is merely a business process and this complaint should be dismissed from our account.  This will be the only response that I will be giving in this matter.  Thank you and have a great day.

    MPG Plumbing removed my Hot Water Heater, after taking it out of my home, in October. I have asked numerous times to return it or replace it. 11/27/2023 pm I had 2 NM State Police Officers accompany me to retrieve the Hot Water Heater. They did not have it, but never had permission to remove it from my property. I would like them to at least give me half of what I have to pay for a new one, because there was nothing wrong with the one they took. I was Quoted by them that I would have to pay $1300. for a new 40 gallon down draft water heater, that would work in my Mobile Home. This company was quoting over $22000. just to replace my water lines under my trailer, no digging or anything like that. I feel they are scamming the Elderly in my community! The NM License #****** they work under.

    Thank you for allowing us to respond to the complaint filed by Ms. *******. He are the facts in the matter:

    1. She contacted us to remove the water heater.

    2. The water heater in question was illegal to have in her mobile home.

    3. She admitted this on numerous instances in my offices in front of the State Police Officers by admitting that her new plumber advised her that she could get the right one at another store in Las Cruces for approximately $1100.00.

    a. She asked me to call the store and verify the price and I did this for her.

    4. She further stated that she bought another water heater and was told that she could not put it back in her mobile home.

    5. We discussed this in my office and agreed that no matter what the old water heater could not be put back into her mobile home. This was in front of the State Police Officers.

    6. She understood this at the time.

    7. The Officers asked what I was willing to do at the time to compensate Ms. *******: advised that I would purchase the water heater that would not fit in her mobile home, that

    she stated she had sitting on her porch so that she would not be out the money for that water heater. THIS WAS AGREED TO AT THAT TIME.

    8. I am currently awaiting contact from her with this information:

    a. Date and time for me to pick up the water heater.

    b. I need the receipt for the price of the water heater.

    c. Where I can pick up the water heater at.

    9. I will only honor the terms of the agreement that we agreed to at the time of our meeting with the State Police.

    10. As far as the Bid we gave her on re-plumbing her Mobile Home (which included a new CORRECT water heater installed by a licensed Plumber), it is a bid; she had the opportunity to refuse the bid, as she did.

    11. I have been in business in this community since 1985 and have never "scammed" anyone. But

    thank you anyway. If this complaint must stand, sobeit. I understand that in business, it is impossible to make everyone happy.
