    August 4, 2021 FFL dealer firearm transfer and background check.This buisness wants to charge absurd fees that were never stated or agreed apon. He claims I owe them $100 for a failed background check that I paid $25.00 initally for, storage fees and sales tax that im not even sure he legally should be or not.I tried to get the original merchant gunprime.com to process a refund or return and they told me to file a police report against Smiths Firearms because he will not transfer my property.Please help fix these issues and get my money back or property released.

    This customer Had a firearm shipped into our store, arrived 9 July2022. He could not be reached tell he can in to fill out the **** to run a NICS background check on 5 August, which was put on a three business day hold by NICS. **** called on 10 August and he was denied he was contacted and told to come by to pick up NICS and state transaction number to file a appeal to  NICS. We are not told what stopped it. Only  he can't have firearms. He was asked to bring payment in to clear charges on sale slip and was informed a failed NICS fee and storage fee would start, If he wanted it sent back he needed to make payment of debt and pay shipped back to merchant. he did not come in tell 2 November tiring to just pick up firearm, That's when he was giving the request for information on denied background check form. He texted later, wanting us to run a free background check again. These cost $25.00 to the state everytime you run one in ******. He has never paid 1cent on his bill. the text with the charged happened in December of 2021. If he had paid up, firearm could have been sent back to merchant. ******** contacted us in November and was informed customer had never paid us anything yet and firearm was held for non-payment. We only sell them after 6 months have past to recoup funds. He has never been cleared by NICS. Firearm was sold for debt in January 2022, debt was cleared. Sportsman's Warehouse sells them after 30 days when customers are denied

    I am rejecting this response because:

    That is a bunch of non sense. I had problems with contacting this buisness from the start and consistantly.

    1. It Is my property, which I believe Smith's firearms or **** has no legal right to keep or sell.

    2 I had problems getting a hold of him in August 2021 and had to wait for them at their convenience to come back from vacation for a couple weeks.

    3. I could never run a new background check or pay my tranfer fee and sales tax!! Did **** ever offer to take payment to rerun the second background check or make payment for transfer and sales tax or to return to buisness to process a second background check, No they did not and would keep buisness closed from me to access.

    He did offer to take unreasonable and unwarranted fees plus the sales tax and transfer fee but never would run the second background check.

    4. Smith's firearms claims ("I was asked to bring payment in to clear charges on sale slip and was informed a failed NICS fee and storage fee would start").

    When did they inform me of a Failed NICS Fee and storage fee? I dont see anything on sales receipt, paperwork, email or message?

    5. **** insued or pleaded I owed him some type of failed NICS fee that I was never informed of and on December 22, 2022 they tried to sneek in some absurd $5 a week storage fee and denied NICS fee which was never agreed or mentioned upon on any sales receipt or any paperwork.

    6. The original merchant tried to help me with a return and shipping label and Smith's firearms claimed I had to pay him the unreasonable fees before he would ship it back. I should of only had to pay for return shipping at that point if original/merchant didn't provide a shipping label.

    7. Original merchant even tells me to file a police report againt this buisness because this is my property and not Smith's Firearms property.

    1- property belongs to FFL tell a passed brackground check is completed and customer pays transfer and state sale's tax if not collected by seller(it was not).

    2- store was closed 14 July to 3 August for summer vacation, customer was informed when contacted when Firearm arrived 9July 2021. He came in first day back on 4 August did **** for back ground check paperwork, but only had the $25.00 for state fee in cash. he going to bring rest when he was going to pick it up.

    ground check, went on 3 business delay. **** called with DINIED on 10 August. Customer called same day voice mail left on his phone number to contact store.

    3 2 November he called and wanted to pick up his firearm. When arrived was giving his failed NICS paperwork for him to get ahold of state. Background checks are good for only 30 days. after that a new one has to be run. He was also informed of fee's on voice mail on 10August and when he showed up in person 2 November, Never offered to pay anything

    4. called later that month asking me to run a free background check again. was informed the cost $25.00 each time you run it and he has to fill out new ****  and pay up to date. He hung up on me.

    5- denied NICS fee is posted on wall of store, also other people have paid in past no problem. We don't see many denied started only after covid started

    6 - He's the one that didn't want to pay He was only here in person twice. only called or texted and threated the store to do harm to it.

    7- local police and ATF agent were contacted and informed about  threat's and trying to get firearm without passing a background check last year

    I am rejecting this response because:

    This buisness again is just trying to say anything they can with no facts or proof for stealing a customers property.

    1.Did the buisness ever put a lean on my property, legal paperwork or written notification?

    2. If this buisness had a sign posted for extra fees then why would they not clarify this to the merchant who shipped it to Smith's Firearms or the purchaser?

    Smith's Firearms at least should have notified me when filling out the initial background check and added a storage fee and notice for failed background check fees to my invoice and they did not nor did they even send a written notice after it failed on August 10, 2021. They demanded money after I contacted them in November instead for unreasonable or made up fees.

    3. If any buisness is gonna charge a fee for a failed background check shouldn't it be the state who charges the aditional $25.00 to process each background check or a state law?

    They want to claim I asked for a free background check. They told me I had to repay and then would never take a second payment of $25.00 and resubmit a second background check. I had no issues with paying an additional $25.00. I sent them a message saying I would pay the $25.00 for new background check, $50.00 tranfer fee and sales tax. this buisness would never accept payment or request me to pay by anymeans, in person, by phone or online.

    I would rather spend the extra $25.00 compared to having $468.99 stolen.

    4. Why would I pay any extra money or fees to return the merchandise to the original merchant/seller other then shipping fees after I requested to be returned to original seller?

    This also would not even involve running a new or second background check, a transfer fee or sales tax either.

    Smith's firearms is one of the worst companies I have ever dealt with or even heard of. This is a legal issue and even more so being a firearm illegally stolen or sold.
