I purchased an item for $763.06 from ********** on June 20, 2024, on the Gunbroker website. I paid for the item and shipping via a certified check number ****** from PNC Bank. The check was cash and deposited. ********** never shipped the item to me.

    Business Response

The person who placed the order did not read our terms of payment (attached)

After he placed order he told us he had sent a check. we did not receive the check for 5 days after the auction ended.

Terms:  ****Payment (and FFL if the sale is for a firearm) must be received within 3 days of auction close. After 3 days all non-paying bidders will be reported to GunBroker and appropriate feedback given with no exceptions.

We told him as stated in our terms of payment: we do not accept checks, he said he would "STOP" the check, ((which obviously concerned us)) then he decided to continue with the sale.

As a courtesy, we told him we would accept his check, when it arrived, and there would be a 3 week hold.

The payment was received on 6/25.

2 weeks later  we shipped the gun to him. He received it and SIGNED for it on 7/12.

I am rejecting this response because: I sent certified bank checks.  I submitted proof of the fact.  Funds are available upon cashing or deposit.  I sent payment **** First Class mail the day I purchased it online.  They held shipment for over a month.  I had to file a report with the BBB and Gunbroker before they shipped the gun.

    Sincerely,

The customer threatened to stop payment on the check. Our policy was explained.  Regardless of his rejection, He has received the item.

I am rejecting this response because:  My paper work submitted proves that the business is untruthful.  It does not take certified bank funds three to four weeks to clear.  The business did not believe I would pursue this attempted fraud.

    Sincerely,

    Complaint: 21974905

I am rejecting this response because:
I received the item over a month after it was paid for with a certified bank check.  I had to file A local police report, a BBB report, and a *** Online Crime report in order for the seller to provide the item.  This is not how a business should be allowed to operate.

    Sincerely,

The BBB did a good job in helping resolve my case.  I wish they had the power to correct the issue of the bad business practices of the seller do others need not go through weeks of effort to get what they paid for.  This business will continue this practice to fraud buyers.  Buyers beware!

Purchased a used ***** lever action rifle on roughly 1/29/2023 for $400. I received a receipt for said purchase. Then on 1/31/2023 I purchased a Desert Eagle **** mag revolver for $1200. The next day when I asked about the status he said there was a new law that I had to have special markings on shipment per some new law. I asked for resources for this and he said he'd send but never did. So I had to send $480 for this special insurance for shipment on top of the initial $30 for shipping. Never got a receipt after the 1st one from initial purchase. The money all got sent to the PayPal account with the address of ************************ minus the payment of $480 for insurance and paperwork which was sent to ************************ per the sellers request. I asked for an update and they said firearms should be here but couldn't verify any tracking evidence and the *** at Magnum Ent in ***************** ********* has yet to receive any products from Spurlocks in NV. I've asked over 6 times for an update on shipment and now I don't even get a response. I roughly have $2000 into this which has already been accepted payments for both addresses on PayPal. This business has some sketchy practices.

On 4/13/21 my now deceased husband, ***************************** bought a suppressor from ***************************** along with several other items totaling $1520.41 (incl. tax). ATF had to issue a tax stamp, so the suppressor was held by Spurlocks until issuance of tax stamp. Unfortunately, my husband died 12/26/2021. Subsequently, in August 2022 ATF issued a $200 refund. I'd been contacting Spurlocks & was told to be patient; I'd be taken care of & that these things take time--I'd get a refund; don't worry because ***************** had been a good customer. On Sept. 9, 2022 they issued me a check for $531.30 (reflecting a 30% restock fee--$759 had been original charge. There was no proration of tax charged on purchase.) I questioned this because I'd planned to buy myself a new gun. I was told they'd knock off $20 & also that I could have been charged a 40% restock fee! I expressed my disappointment & said I felt victimized. Evidently, seniors (I'm 82), veterans and decedents weren't provided the same customer service as others. Things accelerated and that is why I am filing this complaint. My husband, as a decorated purple heart recipient, silver star w/valor, bronze star, etc. and I have been victimized and disrespected--me this week and he posthumously). I say shame on Spurlocks for their shameful, insulting and punitive treatment -- their actions and words are a slap in the face for ************, for me, for seniors and vets in *********, in ** and the ** - they owe ** an apology and a proper accurate credit.
