Jaime Johnson, Will not be eligible for a loan with CashNet USA for some time as stated on the chatbot screenshot because of her default status for proof of NON payment. As for the claim of paying this account prior, She should upload a copy of that paid in full letter so our office can remove her information from further phone calls moving forward. We will follow office procedure and send this delinquent account back to the owner of this file as a refusal to pay along with the BBB complaint.Customer Answer

I am rejecting this response because:
Cash net USA does not own the debt any longer and I have been advised by cash net USA that this business does not work for them and was not hired by them and that this communication has been fraudulent.
Sincerely,
Jaime JohnsonBusiness Response

Please follow the chain of command regarding your outstanding balance as we did and the fact that Cashnet USA no longer owns the delinquent balance it is still a liable debt under your name and last four digits of your social security number. Our office helps consumers understand the legality of not paying a loan back. The chain of command is in place for both the consumer and debt collection & consolidating offices. SWMS will follow the chain back to the rightful owner and they can proceed as their office see's fit.Initial Complaint

I was contacted from SW Mediation from an ********************* stating that there will be a civil action being filed against me from a magazine company back in 2015. She was calling to settle the debt and said that I would be taken to court and that they will play a recording that I am in breach of contract. The business I had I closed at the end of 2014. she said that she has payments made by me in 2015 which again, that business was closed at the end of 2014. I filed bankruptcy twice and any and all debt that I owed was on my bankruptcy.Business Response

My family was contacted by **** from SW Mediation prior to her calling my phone number. I immediately called and she mentioned that she was trying to discuss my account from 2017 *********** and how it would go on my credit report as a negative item. I told her that this was an alleged debt and to send proof. She said the statue of limitations to collect had expired and she was trying to negotiate an agreement to keep it off my credit report. I told her the statue of limitations according to the **** had passed and that she couldn't and that it was also shady as h*** And also she was in violation by contacting my parents. And in violation of FDCPA and 15 U.S Code 1692d. I told her again to send me proof, to cease all communication with me or anyone associated with me and remove me from their list due to these violations. I will be notify all credit bureaus about this and filling a civil suit against the mediation company if this is not rectified. I will also notify ****************.Business Response

****************, ********** contacted you as a third party Mediation Service and not an attempt to collect a debt. Those options and regulations expired under the fair debt collection practice act. Our documentation has a family member as a reference you used when applying for a monetary loan. We used the information provided to us from the client and no other information was used at that point. Per this BBB complaint we are instructed to return this delinquent account back to the chain of title owner as a refusal to pay and you will not hear from our office moving forward.Customer Answer

I have received a call from an ****** stating that she needs to speak with me about a civil action suit but used my old last name. I have not had the name she is using in a long time now. I have yet received any type of bill in the mail as again the last name she is using is old and has not been used in a while. My last name has changed due to marriage, therefore I have no idea what could be owed.Business Response

A women from this company contacted me stating that I owed a magazine company 23 payments of $39.99 from a contract I verbally agreed to from ************************************************************************************* full and if I don't pay the balance the company intended to file a civil suit. I requested the name of the company and reached out to them directly for further clarification. They were unable to find me in their system and stated that no such lawsuit was being filed and if someone was contacting me on their behalf I would need to request debt validation via U.S. mail and to call them back with any reference or case numbers I was given. I have not yet received anything via mail regarding this situation. Be very careful if they contact you for payment!Business Response

This company is leaving threatening messages stating that I owe money to a company but fail to supply any supporting documents that I requested. I told the mediator if its mines i will agree to the plan if provided the right documentation. They said a civil suit will be filed against from 2018. I told them I am unaware of this company. I contacted the company and spoke with Supervisor **** and customer ********************** rep **** from the company they said I owe and they said they are not filing a civil suit nor do they have knowledge of said loan. South West have my personal information and said they received it directly from AWL in January. The company said that's not true.Business Response

**************, Our office follows a strict policy when leaving a message regarding a settlement or unpaid balance on a contractual agreement. The Fact that you contacted a client outside of mediation only leads this account back to the owner and our power is removed over this account. We have forwarded this matter back to title owner on May 25th, 2024 and you will not hear from SWMS again as all information was removed at that time.Customer Answer

My family was contacted by an agent named *************************** from Southwest Mediation Services. I was not contacted. I called to see what this was in reference too and how they got my parents information, when Im 48 years old. She claimed that I am being sued for $2100 by a cash net company for an alleged debt from 2017, related to a company with which I have never entered into an agreement, neither with my signature nor any other documents. I asked for proof and she told me they dont have to send me proof. She said its going to be filed on Monday I informed her that this constitutes a violation of the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), as well as 15 U.S. Code 1692d regarding harassment or abuse, and 15 U.S. Code 1125 concerning false designation of origin, false descriptions, and dilution forbidden. I also stated that there is a statute of limitations on debt collection and she said that this was a civil suit that they were requesting the $2100 plus $3500. I again said I never signed anything. I had identity theft back then. They even had my employment. I said there is a statue of limitations on civil suits and that is 3 years. She kept saying they dont have to send me proof and that it was going to be filed Monday. I requested that they send me proof and cease all communication with me and remove me from their list due to these violations. This company has been calling from the phone number ************. I will be notifying all credit bureaus about this and filing a civil suit against the mediation company if this is not rectified. I will also notify the *** and Clark **************Business Response

****************, As indicated in the phone call after we properly ID yourself this was not an attempt to collect a debt but rather a chance to mediate a settlement outside a potential legal setting as the lender is seeking compensation for a loan you did not honor. In doing so that call generated this BBB complaint and at this point we must send the communication and account back to the our client as a refuse to pay. In closing all of your information is removed from the data base and no further contact will be made.
