On 9/8/2023, I purchased a Peter Lik Artwork at ************ Vagas. I picked a specific frame and paid the full amount ($8,944) onsite. I was told that I shall be receiving the finished framed artwork within the next 3-4 weeks. On 10/2 I received an email from *********************** **************** informing me that the original frame I selected was not available. She presented 2 other frame options. Sadly we had a death in the family so I did not respond to her till 10/23 informing her that without seeing the frame in person I am not comfortable to choose the frame from a picture and requested a refund. A week later on 11/1, she responded that they secured some original frame materials and have resumed production. And if I cancel, I am responsible for 50% restocking fee. I emailed back reiterating that their production issue is irrelevant to me, and that my decision to cancel is based on what she informed me and I do not wish to change my mind again. On 11/15, I received an email on delivery. I forwarded it to ****** pointing out: 1) the order is only valid when the exact product is delivered in the time frame specified. Per the Order Form Clause #3 delivery domestically takes on average 4-6 weeks. And it has already been 10 weeks, 3 days still counting 2) the order is cancelled because they run into production challenges. They did not confirm before resuming production and assumed that Ill be ok with their decision, but I am not. On 11/22, a delivery truck showed up at my house. The driver said he was instructed to leave the artwork at our gate. Who gives instructions like that when the delivery is worth thousands of dollars?! I am beyond mad at this point and so disappointed at how they conduct business and force a sale when they are the breaching party of the contract. I would like to get a full refund ($6,627 due to size change). Alternatively, if I have to take the delivery, 50% discount for all the inconvenience and time wasted. Thank you!

    Good morning!

Please let me know if you have received any response from Peter Lik Gallery. Meanwhile, I have the following proposal:

I understand that there was a production cost already occurred and the difficulty to sell the customized artwork to others. Therefore, I am willing to take the delivery of the framed artwork agreeing to what they offered in their email (attached). However, I do not need another piece of art or book. I suggest a partial refund the total value of tall hey offered including: $250, $495 (the equivalent value of the artwork if I were to choose one), and $2,495 (the equivalent value of the FIVE HUNDRED & B SIDES - ARTIST SIGNED EDITION book if I were to choose it). The total refund is $3,240.

I would like to have this issue resolved as soon as possible. After all, it has been over 3 months since I placed the order. I'd appreciate you keeping me updated on the status

    Regards!

Hello, my bank just credited back the money I spent on this piece of artwork. I assume there is no need to pursue them. Thank you for your help!
