We were misled and misinformed by a Vegas Solar representative named Junior regarding the solar financing. During our discussions, Junior told us we would receive an $11,951 credit in the form of a check, which we could use to apply toward the $39,836 loan financed through *******************However, after consulting multiple tax professionals, we were informed that the $11,951 is merely a tax creditnot a direct payment or checkand therefore could not be applied to the loan as Junior had claimed. This was a complete misrepresentation of the ******** make matters worse, after reviewing our ****************** account, we discovered that despite making 17 monthly payments of $168.84, our loan balance has actually increased to $40,091.81. Its incomprehensible how the loan amount has grown instead of decreasing. We feel we were deceived by Junior, misled by Vegas Solar, and taken advantage of by ******************. When we confronted Junior about these issues, he became defensive and upset rather than offering any resolution. Now, we are stuck with a loan that doesnt decrease, built on false promises and misinformation. This experience has left us feeling scammed and financially burdened by a system we were led to believe would benefit us.

We appreciate the opportunity to respond to the notice filed with the Better Business Bureau.
Upon review, wed like to clarify that Sunlight Financial (the lender referenced in this complaint) is a separate entity from Vegas Solar (the solar installation company). When the homeowner signed the loan documentation, the welcome call had a recorded welcome call of the Solar Tax Credit. While we understand the customers concerns, the issues raised appear to pertain specifically to the financing terms, servicing, or loan agreement, which fall under the purview of Sunlight Financial as the lender. Vegas Solar is responsible solely for the installation and system performance, not financing or loan servicing.
To ensure the complaint is addressed by the correct party, we recommend the complainant contact Sunlight Financial directly for resolution. However, if there are any installation or service-related concerns involving Vegas Solar, wed be happy to assist and invite the customer to reach out to us at ************. We have reached out to the customer and notified them of this.
We value transparency and customer satisfaction and regret any confusion caused by this misunderstanding. Thank you for your attention to this matter

Subject: Rebuttal to Vegas Solar Response BBB Complaint 23356303

    To Whom It May Concern,
Thank you for your response to my complaint. However, I respectfully disagree with your characterization of the situation.
While I understand that ****************** is the lender, the information presented to me during the sales and installation process including discussions about financing options and the solar tax credit came directly from Vegas Solar representatives. At no point was it made explicitly clear that these were separate entities with independent responsibilities. Any confusion regarding the terms of the loan and expectations surrounding the tax credit were influenced by representations made by Vegas Solar during the sales process.

Furthermore, if Vegas Solar introduced ****************** as a financing option, it bears some responsibility for ensuring that customers are not misled or misinformed during that handoff. The recorded welcome call you referenced does not ****** the responsibility to ensure customers have a clear and accurate understanding of what they are committing to prior to signing any agreements.
I am not disputing that ****************** services the loan; rather, I am stating that the issues originated with the way the loan was presented and explained by Vegas Solar. I believe that both entities should be accountable for the overall customer experience especially when one directs a customer to the other as part of the same project.

    Sincerely,
    ****** ********

Vegas Solar had me sign a contract on December 23rd, 2023 for solar panel installation to my primary residence. The company had me finance the panels at a cost of $26,240, plus an additional $20,000 for energy efficient upgrades to my house (HVAC units) through a third party named ***********The payout date for the $20,000 I financed was March 1st, 2024 (at the time the system recieved permission to operate from *********). I have made repeated requests for the $20,000 I have financed without prevail. The owner of the company informed me in May (two months late) that in order to dispurse the money I had to fill out 1099-MISC as if I were employee and the $20,000 were income. My tax attorney promptly advised me that this was inappropriate and that money taken as a loan was not considered income, therefore not subject to income tax.I have since been told by Vegas Solar on seven seperate occasions that I would recieve payment via cash, only for the deadline to come and go without payment. Today at approximately 10am PST, I received a single payment of $1,000 via cashapp from my contact a Vegas Solar under the heading "for food #1".I believe I may be a victim of fraud and that Vegas Solar has no intention of paying the $20,000 back to me.

    Business Response

I have reviewed the contract and the total amount to be finaced was the amount the client described. The original loan amount was for the solar system, which is the lessor amount. The total figure is that the complete payment amount of the term of the loan that includes all the interest for the whole term. There was nothing in the contract that describes HVAC expense. We do have financing for the Roof, HVAC and important elements for property owners requirements. I feel the client was expressing the idea of having that type of financing in the future for his property, but that was not secured for this project.

I am rejecting this response because:

The total amount of the original loan is $46,400 USD, that does include the total for future interest payments.

A 25 year loan for $46,400 at 10.99% would be $138,526.08 at maturation.

SInce the previous email provided by Vegas Solar explicitly confirmed that cost of the solar panels was $26,400 (the lesser amount), I'd kindly ask the vendor to explain what they believed the other $20,000 USD was for? I'd note that the attachment I provided with the DocuSign snip, clearly shows that Ray (the Vegas Solar Rep I was dealing with) that the additional $20,000 was for remodels to be paid out at time of Permission To Operate (PTO) which was in March, 2024.

I would also like to state that I have multiple text messages from Ray and Zoe of Vegas Solar that confirm that Vegas Solar knew it was obligated to pay me the $20,000 they recieved from the finance company. However, Vegas Solar failed to uphold their promises on eight (8) separate occasions before launching the BBB complaint, of which I also have documented conversations.

To date I have only recieved $1,000 USD of the agreed $20,000 USD from Vegas Solar via CashApp. I will be satisfied by Vegas Solar with an immediate payment of $19,000 USD via cash, cashiers check, or money wire. If Vegas Solar does not which to uphold their end of our transaction, the matter will have to be settled in court and the Attorney Generals office.

    Sincerely,

    Julian Batz

    To whom it will concern,

I'd like to make a small nominal correction to my previous response to this case. I had written that the original amount for the Solar panels was $26,400 and the total financed was $46,400. That was an error. The correct amount is $26,240 with a total financed of $46,240.

I would also note that minutes after reading the Vegas Solar response on the BBB response log, I recieved a text message from Ray (the representative of Vegas Solar) stating that Zoe (unknown affiliation with Vegas Solar) acknowledges that she owes me the remaining $19k and wants to pay me immediately.

This acknowlement seems to be in contradiction to the response the company formally gave through your mediation, which insinuates the additional $20k in mention was actually the interest incurred over the lifespan of the loan (which is patently incorrect).

I will pursue Vegas Solar paying me the remaining balance, however, given the track record of failure to comply with their own agreement, I'd like to keep the complaint active until I have received the payment in full.

Upon payout, I will retract my complaint towards Vegas Solar for the payment, regardless of the non-transparent and questionable business practices the company is engaged in.

Thank you immensely for your mediation,

    Julian

    Complaint: 21959628

I am rejecting this response because:

The response of the company has no relevancy towards the complaint.

The company was issued payment from the finance company for $46,240. The panels costs $20,240. The deviation of $20,000 was suppose to go to the homeowner (myself) and the company has not issued payment other than a singular payment of $1,000.

The purpose of the remaining $19,000, and obligation to pay it, has been confirmed on multiple occasions in writing by the company and it's representatives.

The efforts of the BBB to mediate this issue seem to have failed, as the accused party does not seem willing or able to respond to the nature of the complaint in any meaningful way over the course of the last few months.

    Sincerely,

    Julian Batz

    Complaint: 21959628

I am rejecting this response because:

    1) The company has already admitted in their 7/24/2024 response that the solar panels cost $20,420 (the lesser amount). The total amount financed in the contract was $40,240 (attached). The business attempted to explain in the 7/24/2024 response that the $20,000 difference was the cost of the interest at the time of the maturation of the loan. The contract provided easily shows this to be incorrect, and no other explanation has been provided by the company as to why they were given $20,000 over the cost of the panel. I have maintained that the $20,000 was supposed to be paid to myself throughout the arbitration process.

    2) The representatives of the company, Ray Villega and Zoe Cheltin, have substantiated my claims and have demonstrated intent to pay me the $20,000 on multiple occasions over the course of 8 months. They have in fact paid me $1,000 via CashApp in June, leaving the remaining $19,000 unpaid. I have a file of text messages and emails substantiating these claims. The file is too large to upload on BBB website. The company may request the file in full from my lawyer, John Aldrich, with whom the representatives of Vegas Solar are already in contact.

    Regarding your questions.

    1) The company does the finacing, sales and installation of the solar system. The project was completed as per contract.

    2) We have an attorney that is dialogue with his attorney. The lawyer is working on a resolution to the allegations, and I believe that meeting is October 18th to finalize.

    3) I will forward the signed contract. The loan amount is $46,240.00. The tax credit is $13,872.00.

The net cost is $32,368.00. The figure of $20,000.00. or refund, or HVAC equipment, or other energy saving items as Julian Batz stated isn't on the contract.

    Thank you for your response.

    Complaint: 21959628

I am rejecting this response because:

The company's statement lack crucial and necessary context in regards to how the loan was broken down. $26,240 for panels and $20,000 payable to the owner at PTO.

The contract does not specify the reason for the additional $20,000. However, the representatives of the company have made the the initial purpose and intent to pay throughout 8 months of detailed email, text communicatication, and a singular payment of $1,000 towards the initial $20,000.

If the company does not want to honor its initial deal made by its representatives Brent Sharp, Ray Villegas, and Zoe Cheltin, then the homeowner will move forward in arbitration. However, the BBB complaint will remain active until the the remaining $19,000 is paid to the homeowner.

Any additional documents can be requested via John Aldrich, esq.

August 17 2023 had solar installed five employees were on the roof . August *************************************************************** home called Company to come back and check roof at that time. They said no problems. February had rain again called a roofer to look at roof. They found a hole in roof broken tile and a cardboard put underneath broken tile called solar company with no help so I hired Ohana Roofing. to make repairs

    Business Response

    Date: 05/24/2024

We are writing to the complaint filed by ******************************** regarding a potential roof leak following the installation of a solar system on his home.

We were notified of the issue on February 23,2024, following a period of rain. In response, we sent our lead technician to the property. Upon inspection, he found a significant pigeon nesting, that had a large amount of f**** See the pictures that have been uploaded. You can clearly see the f**** had significantly rotted the material below it. The location of this was not near the solar installation, as you can see there are NO solar panels in the picture. We tried to explain this to the homeowner, but they did not understand.

******************* hired ********************* to do the repairs, then contacted us for re-imbersement. He was notified that we were not responsible for the damage. We contacted ***** of ************* and he verified the damage was not done by our solar installation, but by the pigeon investation. See the screenshot of the text message via phone.

We take care of all are customers and strive to address the issues. There clearly a mis-understanding and the damage was unrelated to our work. We had relayed the findings to ******************** and the screen shots from the roof technician. We request this case be closed and this was a false complaint. Because of this our ratings have gone from A+ to a C-.  This has caused stress to our company and we are losing credibility and losing jobs.

A sales representative agreed to install a solar system for $30K. He explained to me and my wife both, that the price was going to be $30K, but that after the 25 year loan, with interests, it would be a total of $40,500. This was all verbal, other than the notes my wife and I were taking. When they send me the contract, I saw the $40,500, but both my wife and I thought they were showing us the final price (after the 25 year loan). Turns out that what we were signing was a $40,500 loan, NOT a $30K loan. When I called the rep. he called the owner (of Vegas Solar) and he said that the loan was $40,500 because I was paying fees to the loan company. The loan company denied that. The three of us had another phone call, and this time he said that the extra $10,500 was to bring down the interest rate. The loan company denied that. At one point, I called the loan company, their employee, the owner of Vegas Solar and myself were on the phone. I asked permission to record the conversation and they agreed. I asked the loan person if I was being charged any fees, and he said no. When I asked the owner of Vegas Solar if he remembered that that is what I was told by his sales rep, his answer was "no comments" and I have that recorded. In order to come to an agreement, without litigation (or putting a complaint here) I asked the owner to canceled the loan, and that I would pay him the $30K cash. Today he told my wife that the loan company said that is not possible, however, the loan company told me that they can, indeed cancel the loan. That Vegas Solar would have to return the funds to them, and the loan would be canceled. Vegas Solar says otherwise. Now I'm stuck with a $40,500 loan, instead of the $30K they agreed on. There is a reason why if you ****** "Vegas Solar" the company doesn't show up, there are no reviews, nothing. Hopefully when someone ******s them now, they will find this. I'm hoping they do the honorable thing and cancel the loan and accept the $30K cash.

My top sales representative explained a client was very close to signing a contract for the installation of the solar system on his property and asked if I could do a site survey to verify the service panel and confirm the system size would fit on his roof. I completed the survey and confirmed everything was ok.

I would say a week later, he said the contract was signed and we could install at the end of the week. I met the homeowner and he was excited we were installing.

Our contract states the client has 3 days to cancel the contract. We had exceeded that time frame and the installation was completed.

Then after the installation was completed, he started texting, then calling, saying he didn't understand the loan documents. He said he was a teacher, and he spoke good English, I assumed he could read. Then he started saying (bragging) he was going to Sue ******** and became very combative (multi-personality like)

The *************** has their rules, the installation was completed and the project needs to be commissioned, but he told me to not go on the property. I have several clients who have offered their contact information for referrals. I have never had a situation like this. This person just doesn't seem to have his mental thinking together.

I am rejecting this response because: The owner keeps lying about this, and, as you can see, is being very disrespectful by insulting my intelligence and my mental state. What kind of company owner does that, on a public place like this one? It clearly shows the kind of company this is.

I never stated that I did not understand the loan documents. I stated that the loan amount, submitted by them to the loan company, was incorrect. The loan was supposed to be for $30K, but they submitted the documents for $40,500. Only 5 days after signing the contract I noticed that. When I asked why the loan was for $40,500 that's when they came up with excuses (lies) that their OWN loan company denied. They claimed the extra money was to pay fees to the loan company, which the loan company denied. Then they claimed it was to bring the interest rate down, which the loan company denied also. When the loan company denied that, the owner of this company was part of the conversation. When asked if he remembered they told me it was to pay fees, and then to bring the interest rate down, his response was, "no comments". He refused to accept and admit that that's what I was told. I have a recording of me asking the question, and him refusing to comment. I can use this recording because I had permission to record the conversation. In addition, he claims the loan company won't allow him to cancel the contract, which is a lie because they told me all the owner needs to do is return the funds to them. So, yes - my English is good enough to understand everything, and my mental state is good as well, but when people lie to you... that's a different story. . In addition, I'm not bragging about suing them - how do you even brag about that. They were simply informed that I was going to get legal representation, and I did. There is nothing to brag about that. I guess his lawyer and mine will have to find a way out of this.

The owner has been telling me to deal with the loan company because he had done nothing wrong. The loan company did the right thing and fixed the problem (changed the loan to $30,500). I contacted the owner last week and gave him green light to continue/finish the project. I told him I would close this complaint and delete my ****** review upon completion of the project. I got no response from him and neither did my attorney. Today (after a week), I followed up and asked him to confirm whether he was going to finish the project or not. He said he is waiting for his lawyers. I did what he asked, which was to deal with the loan company, so I don't know what the problem is now. It doesn't sound like he wants to finish the project, even though the loan issue has been resolved.

There was a settlement document drafted by their lawyer. My lawyer responded to the document with corrective facts. They declined to move forward and sign the settlement document.

I am rejecting this response because: the loan company ruled YET AGAIN in my favor and decided to cancel my contract with them. They ruled in my favor because they realized that there was NO REASON for Vegas Solar to not finish the job. When it all started they said the loan company told them they didn't do anything wrong and that the loan company told them they couldn't change the loan amount or cancelled the contract, EVEN THOUGH the loan company kept telling me otherwise. Well, I was telling the truth because not only they changed the loan amount, but now they also cancelled the contract. Do I need any more proof that I was telling the truth? When it all started we offered them $30k cash and they rejected it. Then they told us they were not going to include pigeon guards or the three months rebate and we accepted that and yet nothing happened. Then they started making demands like for me to FIRST close this complaint and delete my ****** review if I wanted my job finished. Since when does a company rule against you TWICE and yet you make demands to finish a job? We sent them another offer and they have until the 17th to answer. It is my FINAL offer before sending everything to the board of contractor's and start litigation.

    Sincerely,

The situation / case is in litagation with lawyers. I am not sure what else can be commented on at this point.

The case has dialogue between each parties lawyers. I don't think a case has been created. The lawyer descibed it as going into arbitraation. But I don't think that has been established. I believe my lawyer feels there will be a quick solution once they respond to his response.

The BBB is correct - at this point I don't think the BBB can do anything about this. When this all started Vegas Solar said the loan amount can't be changed - that was a lie because the loan company changed the amount. Vegas Solar said the loan cannot be cancelled - that was a lie because the loan company cancelled the loan due to the fact that Vegas Solar had no reason to abandon the work. Also at the beginning, I offered Vegas Solar $30k cash to cancel the contract and they rejected it. All of a sudden, when the loan company cancelled the contract, Vegas Solar was ready to finish the job. I offered them $10k cash to finish the job and their counter offer was a joke - their counter was for me to pay them $30k cash. That was MY OFFER to them back in March, and THEY rejected it. The reason I offered $10k is because I am deducting the legal fees that I had to pay BECAUSE of them. The ONLY way this will end is when the board of contractors forces them to release the job to someone else, or when the judge rules in my favor like the loan company did. I am in no rush though since I don't have to make any payments anymore.

My lawyer is in communication with their lawyer. The $40,500.00 loan was canceled and we are accepting the $30,000.00 cash offer as requsted by the client.

There is no $30,000 cash offer. That offer was made 5 months ago, before getting lawyers involved and they rejected it. In fact, even after hiring a lawyer I made that offer to them. I accepted what THEY asked for, which was to reject pigeon guards installation, and reject 3 months of rebate that they had originally offered. I accepted all of that, and they still never completed the job. This is not only all in my lawyer's records, but it is also all here in the BBB. The BBB knows this, so they should consider lowering the rating score of this company. I have no problems waiting for a resolution as I don't have any financial obligations anymore. The last offer (and it will be the last one) my lawyer made to them was $20K financed. We are waiting on a response.

Their counter offer was once again a joke. They expect me to pay them $25k CASH, as if I was a bank that can just produce money. Not only that, they want me to use them to finish the job OR use someone THEY send. In other words, they still think they can make demands.

There are no negotiations going on, as I told my lawyer I am not making any other offers. I am done negotiating.

Please ask the person who wrote that to edit it and simply put that we came to an agreement/settlement. Not everything that was said there is true. For example, it didn't take me a year to save to pay them cash. When the conflict first started I asked them to cancel the contract and I would pay them cash, which at that time was $30k. They refused. Even after hiring a lawyer, we offered them the same $30k and they rejected it. Other things in that summary are not true, and I do not feel comfortable agreeing or accepting that. I do agree that I had no issues with the installation, so yes, the installation was done properly. Lastly, I have not received proof of payment/ownership yet. To me, this is in the past, and has been resolved, although I am waiting for proof of payment/ownership.
