    On ********************************************************************* It Windo Fashions. came to my home for a window treatment consultation. During the conversation I told her my vision for the window treatment design I wanted for my 14 Windows. I have a set of two large windows and I wanted one blind on each set and single blinds for the additional 10 windows with each having a flat pull bar. She convinced me that her company could do exactly what I wanted, so we agreed on the design. She told me it would be a 50% deposit totaling $6361.50 and that once we agreed we could not cancel. On Sept 19th she came back to my home to measure with her father. It was at that time that I was told it would be impossible to do the larger set of two windows with one shade and they could not do a flat bar; it would have to be a round bar instead, all of which I did not want! I made it very clear that I was not happy with that design, she came out an additional 3 times trying to convince me to go with what they could offer. I tried working with her, even asking for a different product. What I chose once she did the calculations was an additional 20K of the total cost. I was not happy with the new desigh of 14 shades and a round bar instead of flat. To this day my order was never processed because I could not pull the trigger on something I was not happy with! Cover it Windows contract states "it is for the work specified on the contract" The contract shows blinds to cover 12 windows which is also the design I was sold on. However they are unable to deliver what they sold me and refuse to give me my money back! This company is a scam! They did a bait and switch and now refuses to give me my money back and accept a design I never agreed to. I believe they thought they could take advantage of a senior citizen. I want my money back from this company. They sold me on something they can not deliver and want me to accept what they can. and I refuse to do that and am requesting my money back.

    I am so sorry that I did not see any of the email responses from the BBB until I received the notification of the account being closed today.

    But looking at the response from this company proves that they are such liars. This is not about the product, it is about the design we agreed upon.. I have (14) windows. The contract shows (12) shades total, which is the design we agreed upon and that the contract was written for. They were suppose to cover a set of 2 large windows with one shade which is how we came to (12) shades for the (14) windows which shows on the contract. However when they came out to measure it was at that time that I was told they would not be able to do the one shade for the set of 2 large windows and the flat pull bar, I now had to do one shade for each window 14 with a round pull bar one. which I made very clear that I dont like.This was a totally different design than the one the contract was made for. Their contract states "which they clearly forgot to highlight" that all products are guaranteed to be as specified. Howerver, they are unable to provide the design that I signed for on the contract 12 shades and a flat pull bar.  For this reason, I would like my money back!  You can not sale me on a design "not a product" and then later say, Oh, sorry we can not do the design we agreed upon so you will have to take what we give you because there is no refunds.

    Please see the email between my from Cover it Windows Fashions showing that what they are able to provide is different than whats on the contract. 14 shades with a round bar.

    There are other companies that can give me the design that I asked for. This company can not.

    In addition to the last emails showing the design and amount of shades the only other corespondence was a friendly reminder to pay the balance and schedule for installation on blinds that were never ordered,

    Ahain what this company is trying to install is something different than whats on their contract. The contract shows 12 shades, They want to install 14.I requested a Flat bar which she said they could provide and tthey want to provide a round bar now stating that if I wanted a flat bar it would be at my own risk,  Rhianna agreed to the dedsign on the contract which I gave a deposi for and changed it 10 days later.

    The only resolution for me is a full refund of my deposit, as I should have the design per contract, and not what they are able t provide,

    Ii don't understand why the BBB is satisfied with this response. This company who has mostly bad reviews are making this about no additional cost to me lnsteaf of them not being able to provide me with the DESIGN  we agreed upon on the contract. I do not want 14 shades. I want 12  which is what we agreed upon. And regardless to what they so eloquently write  to you, they told me that their company is unable to provide that design style because of the way it needs to be mounted and if I wanted to go ahead with the 12 shade design of would need to sign a disclaimer because they know the fit will not work.

    She should have known this when she told me on contract that she could deliver the design of wanted..

    So this is not about the fact that there were no additional cost to me, or two extra blinds, It's about this company telling me on contract that they could deliver what I requested taking my money and later telling me they are unable to provide the design we agreed upon, leaving me, the consumer dissatisfied with the outcome.

    Date of Transaction: Late afternoon of Tuesday, May 28, 2024. Date of Request to Cancel Transaction: 6:50 am Wednesday, May 29, 2024. I cancelled the transaction because I felt it was to expensive for shades for 5 windows/sliders. Amount of Money I Paid: $12,966.87. I was told by the sales person, while at my home, that in order to get on the window shade production schedule, I would need to give her 1/2 of the full proposed cost while she is at my home. She advised me, that if I did not give her a deposit while she was at my home, there is no telling when I would get on the production schedule. As such I reluctantly gave her a **** payment for 1/2 of the proposal in order to ensure I was on the production schedule. Knowing at that time that I understood I could change my mind per her own words and being aware I was protected under Nevada Revised Statute *******. Nature of Dispute: At the time I signed the proposal using the sales persons IPad I was not shown any disclosures nor advised that by signing the proposal I was entering a non canceling, non refundable contract. Also, I did not receive a copy of the contract at time I signed it in my home, nor a receipt for my deposit. I understood a contract would be forthcoming the next day, which I would sign to complete the purchase. The contract/proposal I received late Wednesday, contained disclosures, in particular the disclosure that I am disputing. The disclosure reads, I understand this transaction is made at the place of business of the seller and hereby wave the right to cancel the sale within 3 business days. This disclosure does not apply to me since the transaction/proposal signing took place only at my home and not the sellers place of business, and therefore I am protected by NRS *******. The statute reads Right of Buyer to rescind contract of sale; notice of rescission. Any buyer who enters into or signs a door-to-door sale contractmay rescind such contract by giving written notice to the seller.

    The consumer came to our place of business unsolicited. The consumer met with one of our sales designers to discuss and select window coverings for their home. After thorough consultation, the consumer then invited the sales designer to their home for final measure and final selection of the products. The sales desinger then arrived at the home on the scheduled date and time.Once final measures were taken and product selected, exact pricing was provided. The proposal/contract is a detaild document indicating each window and the treatment selected and the line item price provided.The consumer was happy with the product selected and the total price provided. The consumer was then advised that product would only be ordered once the deposit was received as per company policy and is standard in the industry. The consumer then, seeing the total proposal and pament terms as indicated on the proposal, agreed and signed the proposal/contract.

    Ths consumer then submitted his credit card for the deposit. The credit card was submitted on the terminal as per the credit card processing company terms. The consumer then signed the credit card authorization. The order was then submitted electronically to the manufacturer for processing and manufacturing. The terms of the signed contract are very clear and unmistakable: "All products are custom made *** may not be cancelled. Orders are non-refundable."  The consumer stating he was unaware and did not see a contract is a false statement. The signature on the contract proves so. The consumer submitted a dispute with their credit card company requesting a refund. The credit card company determined that we were in compliance and ruled in our favor. At this time the consumer is actually in default of the contract and is liable and owes the balance of $12,960.87 for the product ordered. The *** statute the consumer is siting is applicable only to and clearly states "door to door" sales solicitation and does not pertain to this type of transaction. There is no provision here for a 3 day right to cancel. I strongly encourage the consumer to not default on the contract and pay the balance and allow us to install the ordered window coverings. In the end he was fully aware and all details were disclosed at the time he signed and as the contract states there are no refunds. We have every right to persue legally and collect the balance owed on the contract. I recomend that the consumer pay the balance and allow us to install the window coverngs.

    I am rejecting this response because:

    We like ****** ******* products and as such I discovered through the internet that Cover It Window Fashions carries their products. We went to their place of business to ascertain that it was a legitimate business and since we were there, briefly viewed some of the products on display. (Note that we had visited several other small businesses that day as we do as a matter of practice.  We were in the process of renovating our new home. I am 71 years old, and my partner is 81 years old, and as such given our ages, we visit any small business we may potentially be doing business with to feel comfortable with the business and more importantly feel comfortable with allowing them to come into our home.) Under no circumstances while at their premises, did we commit to any product or agree to give our window covering needs to Cover It Window Fashions. During our short visit to Cover It Windows Fashions, I spoke briefly with the sales designer about some of the products on display and after feeling comfortable with her, I asked to set up an appointment to come to our home for a consultation, i.e. discussing window coverings, viewing samples, and pricing. There was never any thorough consultationat Cover It Windows Fashions premises with the sales designer about window coverings. When she arrived at our home, she showed us samples and took measurements. At no point did she disclose that the measurements she took were final. We understood once we contracted with Cover It Window Fashions, that an installer would come out to do a final measurement of the windows before production would begin. (Other businesses we have used who visited our home, such as the window coverings company we ended up using, several closet design and install companies and interior renovation contractors, all took preliminary measurements for pricing their quote for the work or project to be completed. In each case, we were asked to sign off on their quote, ie, that we agreed and understood the work required and the associated costs. In each case we were provided with a copy of the quote at the time we signed it. Once we decided on using a particular company, a hardcopy or electronic contract was provided to us for our review at our leisure and following answering any questions we may have with respect to the contract, we would sign and return it to the company. Once we signed the contract,we were then asked to provide a down payment to begin the project or production. In the case of the window covering company we chose to use, once a payment was provided to them, an installer was sent to our home to accurately measure the windows before any production of the product could begin.) At the time the sales designer showed me her quote on her iPad, I was someone shocked as I thought it to be expensive and verbally stated the price to my partner.When the sales designer asked me to sign what I believed was her quote, I did so willingly. (Please note that QUOTE is also noted on the top of the page I viewed and signed off on, which gives the product descriptions, measurements,and pricing.) I was never made aware of disclosures that were apparently tied to the quote page, nor did the sales designer verbally point out or highlight that by signing this document, I was entering into a non-cancellable, non-refundable contract and forfeiting my rights under Nevada Revised Statue *******. The sales designer also strongly suggested at that time I signed off on her iPad,that we should give her a deposit equal to of the quoted cost in order to get on their production schedule list. She clearly stated that if we did not give her the deposit while she was at our home, that there is no telling when we could get on the production schedule list for window coverings. I, therefore, reluctantly gave her a deposit for ($12,966.87) to get on this list believing at the time I gave her my credit card that I was protected under NRS ******* should I change my mind about using Cover It Windows Fashions for my window coverings.She also told us she would be processing my payment and providing us with a contract the next day. She then advised us she had to hurry to another client meeting. She left without leaving us any form of documentation, i.e. no copy of the document I signed, nor a receipt showing that she had in fact processed my credit card payment at the time she was at our home, even though she told us the payment would be processed the next day. The next morning (6:50 am), or approximately 14 hours after the sales designer was at our home and I signed the document (4:28 PM), I sent her a text as can be seen in the string of texts I sent with my initial complaint, asking her to hold off on putting the credit card payment through as I thought the cost was unbelievably expensive and would need to think further about the purchase. I also asked for a copy of the contract I thought would be forthcoming. It was only during this string of texts that we learned I had erroneously signed off on a contract already and supposedly gave up my protection under NRS *******.  As for my credit card company, they advised me the only reason they could not reject the payment was that a signed contract was provided to them by Cover It Window Fashions.They further advised, they were not in a position to investigate the application of NRS ******* to the signing of the contract or the circumstances surrounding my erroneously signing such a contract and recommended seeking help elsewhere. In closing, I would like to say that while it appears there may have been some misunderstanding between both parties, we cannot understand why we our being taken advantage of financially by Cover It Windows Fashions. The sales designer was advised very early in the morning of the next day to stop the payment and such my order most likely did not get entered into any production schedule list, let alone any work starting on the actual production of the window coverings. As such Cover It Windows Fashions has not been hurt in any way financially by this transaction, while we are currently out $12,966.87. The contract was also signed in our home and not on the premises of Cover It Windows Fashions. Therefore, the disclosure in their contract waving the 3 days right to cancel does not apply.

    Hello-  I have already outlined specifically the terms of our contract and the sales process. To re***rate, there are no cancellations. I have no further comments nor wish to continue the dialog further.

    I have been in business 30 years and have always desired and have been always fair and honest. What good is a contract if no one abides by it? We have hundereds of orders every month and we have processes we must abide by. We are consumers as well and must abide by contracts that we sign and do! We rarely have any issues such as this as we run a professional and legitimate business. You can check my record with BBB. However, and i have NEVER offered this, In order to resolve this issue, i would like to offer a very generous discount. I would like to discount the contract $3500.00. This way the consumer can get the product that they desired and not loose thier deposit and we will not suffer a loss as well. We are now scheduleing installations *** late September early October. We can revise the balance due and once paid we will schedule installation. It's interesting how no one is concerned about our losses. We go ahead and purchase custom products and then loose money because we can not collect the balance.

    How about some compassion for the business taking a loss? We would have to go to court to protect our interests as you still owe the balance. Again, i ask to accept my generous offer and allow us to install the products that you were SO excited to get.

    Cover It Windows Fashions (CIWF) continues to ignore the real truth of what transpired on May 28 and 29, 2024. I dont believe they have even read my response, or they would have known we ended up using one of their competitors for our window coverings. I clearly stated in my text to the sales designer on May 30, 2024, (the result of learning I had signed a non-cancellable, non-refundable contract and apparently forfeited my rights under Nevada Revised Statue ******* (NRS *******) and that she had processed my payment the day I signed this contract rather than the next day as she advised us that she would do on May 28, 2024), that we did not trust her and therefore, would not do further business with her. **** states they have always been fair and honest, yet the sales designer did not show me on her IPad wherein I unknowingly signed the contract, the associated disclosures, or point out that there were important disclosures attached to this document that should be read, nor verbally advise me that I was signing a non-cancellable, non-refundable contract and forfeiting my rights under NRS *******. We feel we were taken advantage of given we trusted her. The condo and renovation are probably our last home and renovation and as such we were using monies earned from our old home sale and savings to renovate our new home. The monies **** is attempting to keep from returning us represents funds we have saved for our retirement years. We are 71 and 81 years old respectively and live on a fixed income. Where is ****'s compassion for us the customer, the same compassion CIWF asked for themselves in their last response. Also, from the time I unknowingly signed the non-cancellable, non-refundable contract in the late afternoon of May 28, 2024, to early the next morning of May 29, 2024, when I told the sales designer via text to hold off on processing the credit card payment I gave her, only 14 hours had elapsed. The sales designer also left in a hurry,without leaving us any paperwork, as she stated she had another client to see. There is no way over the 14 hours that elapsed, which is mostly overnight, that the window covering order could have been both submitted by the sales designer to ****** ******* and production of the window coverings started by ****** *******. Remember,the sales designer advised us to give her of the cost of the quoted figure for the window coverings in order to be sure to get on ***** production list,which she stated was at least several months out for a new client's window covering production to begin. Lastly, while we believe a contract containing language waiving our rights under NRS ******* may not be legally allowed, regardless, the disclosure in the **** contract clearly states, I understand this transaction is made at the place of business of the seller and hereby wave the right to cancel the sale within 3 business days. As I pointed out in my last response, this contract I unknowingly signed was signed on the sales designers **** at our home! Not their place of business!
    While we feel under the circumstances described above and in my earlier comments that we should be fully refunded our deposit of $12,966.87, we also feel that in order to avoid legal fees and the time wasted by both parties in the process of taking this matter up in the courts, we would be okay with CIWF keeping $500 to cover the time their sales designer took to come to our place and review and discuss our window covering needs for 5 windows/sliders.

    In September this year i purchased 3 window covering from that company one of the window was a *************************** vignette modern ***** shades its a very expensive window cover i paid for everything in advance when they install the *************************** window we found out its defective the remote control was not working and when i called the rep that sold it to me she was very **** and unprofessional 3-4 weeks went by and i wrote a review on ****** about the horrible service of that company today on 12-29-2022 they called my wife that the finely got a replacement of the window cover but they say that if I wont remove the review that I wrote they wont replace the window cover again they show how unprofessional that company is
