Dear Better Business Bureau, On September 27, 2024, I entered into a contract with Moken Home Improvement to perform work on my home The scope of the project included demolishing and reframing over the garage, as well as constructing an overhang on the front of the second-floor upper wall. The complete terms of the agreement are outlined in the two attached PDF documents. To date, I have paid the business ******. However, the work remains incomplete. I have attached photos that clearly show the unfinished state of the project. I have made multiple attempts to contact the company via phone and text, but their responses have consisted of various excuses -- such as vehicle breakdowns and other delays. At this point, the quality of service has been unsatisfactory, and I simply want the contracted work to be completed as agreed. I would greatly appreciate any assistance you can provide in helping me resolve this matter. Moken Home Improvement has updated their address to the following: ************************************************** Contact information: ******* ****** **************Business Response

As per our contractural agreement, we explained to our client that another payment was due to complete the outside of said property. The inside is completed, and that portion of contract the is complete. Client wants us to complete the work in its entirety in order to get balance due. Balance due is a substantial amount and we need partial payment to get material needed to finish. Weve done extra work (not on contract) for said client and didnt charge. Weve since been in contact with client and issues are being resolved. Were all in agreement in next steps needed to complete our contractural agreementInitial Complaint

hired ***** ****** and Moken for a kitchen demo and remodel. He initially quoted $34000 for the project but forgot a couple of things I wanted. Final quote was $37,900. He required $17000 deposit stating he always require 1/2 to start job, get supplies and pay his workers. Which was paid by check and cashed on 2/15/24. His workers worked in my home until 2/23/24. That was the last day they did any work in my house. At that time he stated work was complete he only needed to order cabinets. I wanted white upper and black lower cabinets. On 3/11/24 requested an additional $12,000 for cabinets. I didn't understand since we had already discussed cabinets. The check was written and cashed on 3/12/24. I didn't understand why he needed another large payment so soon. He assured me it was for cabinets. From that day through May 2024 he kept telling me my cabinets were on backorder. That black cabinets were hard to get. In late May he said he was sending his cabinet guy to measure for cabinets. So I asked, how were my cabinets supposedly on backorder if no one had any measurements and had shown me any designs? His cabinet guy came to my home in late May to measure and informed my daughter and I that infact NO order had ever been made. That *** ****** had contacted him just 1 day prior regarding my project and it would take at least 6 weeks to get cabinets. I had already been waiting since the end of February 2024. At that point *** ****** offered to buy white cabinets and spray paint them black and I refused. I requested a refund verbally and in writing and *** ****** refused. There has been no communication between *** ****** and myself. I still have no kitchen for nearly a year and was forced to find another company to start to complete the project which is costing me so far another $25000! Not to mention the cost of having to eat out everyday for nearly a year for my family and myself due to not having a working kitchen. I am requesting a refund of moneys paid.Business Response

We were hired by this client to do a full kitchen remodel where client stated that client would like to have different color cabinets, white for the upper cabinets and black for the lower cabinets. The cabinets client chose did not come in black so it delayed the project because client only wanted the cabinets client chose. We had two different cabinet companies trying to find cabinets that would fit clients needs. One of those companies expressed to client that they can custom paint the lower cabinets if client chooses and client refused. We couldnt come to an agreement to rectify the situation. We pleaded with this client on numerous occasions to let us finish their project. We demoed the entire kitchen to the studs. We removed a wall and installed a header for open space into clients dining room. We upgraded the electrical, moved plumbing lines to accommodate new placement of the kitchen sink. We installed a new kitchen window and moved it 3 ft. We replaced sub flooring and installed cement boards and tiled the kitchen, foyer and hall. We installed new drywall throughout the kitchen and hall and painted. We Installed new recessed lights and outlets. The only thing left on contract was installing the cabinets and countertops. We reached out to try and resolve this matter to no avail. We sent client countless text messages asking to let us finish the work. Were still onboard to finish this project if client agreesCustomer Answer

Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:
I am just getting to review the email regarding this complaint. I see the companies response regarding wanting to finish the project. It has been a year since the project was started. He stopped communicating with me over 8 months ago and at that time he was offering things that I was not in agreement with. I have since already hired another company and am in the process of having the work completed by someone else. This is not resolved and the only thing he can do is refund my money

During our time on this project we made many attempts to Complete the work and pleaded with client to. We have countless text messages proving this. Client wanted cabinets that our contracted companies could not provide and we gave her other options which she refused. Clients states that we stopped contacting her. To be clear client is the one that fired us and told us not to come back. When we received the letter we tried to resolve this issue and even pleaded with her to let us finish. Cabinets installation and countertops were the only things left on the to do list. We installed new electrical wiring and installed receptacles and recessed lights, new drywall, new flooring tiles in foyer, hallway and kitchen. Removed wall and installed header between kitchen and living room. Relocate and installed kitchen window and painted kitchen. We did 85% of our contractural agreement. There is still a balance due on contract which we were going to collect once job was completed. We did not get paid in full. Weve tried to resolve this matter to no avail.Initial Complaint

Dear **************,
I understand that you have been through a challenging situation since August 14, 2022, when your house caught fire. I want to assure you that I sympathize with your predicament. However, I must address some important points regarding the project and the payment issues.
Firstly, it is crucial to clarify that over 75% of the project was completed. As the contractor, I diligently carried out the necessary work to restore and rebuild your house. I invested a significant amount of time, effort, and resources into the project, totaling around $200,000 as you mentioned.
However, it is disheartening to note that we were not paid in full for the work we completed. The insurance proceeds, which were meant to cover the project costs, were not given to us in their entirety. This incomplete payment has severely impacted our ability to continue the project and deliver the final outcome that both you and we desired.
We understand the frustration this has caused you, as it has also affected our ability to demonstrate the extent of the work performed.
In light of the circumstances, I urge you to take appropriate actions to rectify the situation. It is essential to engage with your insurance company to clarify the discrepancies and seek the necessary documentation to support your claim.
Please understand that we, as the contractor, have also been affected by these payment issues. We have invested our time, skills, and resources into your project with the expectation of fair compensation. The incomplete payment has not only hindered our ability to continue working but has also caused financial strain on our end.
I empathize with your frustration and disappointment throughout this process. It is my hope that we can find a resolution to these issues, ensuring that both parties are treated fairly and the project can be completed satisfactorily.
Sincerely,
*******************************
