    I got an estimate from Nick from Nick's Outdoor Services to remove a small tree (1/2 hour), grind several stumps and roots, rototiller the lawn and, make it smooth and level (2 1/2-3 hours) so I could plant new grass. The estimate was $1450 which I accepted. When he had finished, I thought that the lawn was not smooth or level enough and his response to me was that when it rains, it would level and smooth on its own. Was I supposed to believe that, I thought, but did not challenge the statement since it sounded so unreal. I had to work on the lawn an additional 4 hours to get it smooth and level. When he requested payment, he said that would need to add tax ($116) to the estimate for a total of $1566. I said that I thought that the estimate was the cost of the job. He said that it is NY State requiring the tax not him. I asked him to write up a new bill and wrote a check for $1566. Can a landscaper charge more than the original estimate. Can they now say that they did not include the tax in the original estimate and that it is NY State requiring the tax, not him. Thank you for your time and help.

    The customer received a written estimate for the work. The line item had the description of the requested work and the cost for this service on that line. The fields at the bottom of the estimate for Subtotal, TAX and Total were left blank.  Above this area is the clear statement "Additional 8% Sales Tax On All Bids". NYS considers this a taxable service and requires the collection of sales tax.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. 
    I was not aware of the tiny type on the estimate which says that Additional 8% Sales Tax On All Bids and the business did not point that out to me at the time of the estimate. I would like the $116 above the estimate be returned.
