      I hired DS Handymen to plow my driveway for the 22/23 season and paid him $1100.00. Mr. S****** did not hold up his end of the contract. On the first snow fall I waited a few days and contacted him on what his plan was and I was shocked at his response of asking me if I knew anyone with heavy equipment and left me to figure it out. A friend of mine came over with a payloader and cleared my driveway. I asked Mr S****** if he could please just do a clean up. 5 days later I still did not have anyone here so I sent Mr S****** a message and he said he will get someone there. At around 7:00 pm a man came and plowed my neighbor's yard, left ruts, took out his sewer pipe then continued to plow half of my gardens handy stone and dug into the side of my driveway with the plow blade. He was upset at what he did and left, I never got my driveway cleared. Later that evening I received a call from my tenant that this damage was done, I never received a call from Mr. S******. I requested he return my money and he refused. On the second storm which was again a freak storm, 9 days after the storm ended I had not heard a word from Mr. S******, once again my friend came with his payloader after I contacted him in tears because I was left in my own again. I did contact him to let him know that Mr K**** did his job again. Then on the third snowfall of about 6 inches the following afternoon I was still not plowed out and no word from Mr S******. Once again my friend came with his plow and cleared my driveway. Still not a word from DS Handymen. On the last snowfall of the season of about 2 inches which was under our contracted amount of 4 inches or more Mr. S****** came and plowed. I have once again requested a refund and he refused. Mr. S****** cleared out 2", left me to clear out 16 FEET and he had the nerve to tell me he provided service. I am requesting once again that he return my $1100 for not providing the service I paid for.

      to whom it may concern, My name is Dave S****** , I am the owner of DS HANDYMEN INC.  I am responding to a complaint made by ******* ******.  There are a few details about this complaint that need to be clear. I do admit that the 2022 / 23 snow season was extraordinary. we had 2 major storms that impacted the Hamburg and Blasdell area. Ms. ****** and I completed a contract before the snow season started. the charge for her driveway was 1100.00 on this contract is states clearly that if the snowfall is beyond the means of my equipment heavy equipment may be needed to clear the snow fall. This is also at an additional expense to the customer. These 2 mentioned storms did qualify for the need for heavy equipment. The contract also states that during this type of snowfall there will be delays and in the event of travel ban or state of emergency we cannot be on the road.  I certainly do not want to hide behind my contract. My company did encounter some needed repairs and getting those repairs on these days during these storms were quite difficult. During storms such as the ones we experienced other companies were out providing service. most customers that were able to take advantage of a quicker snow clearing did. There was a time during a storm that one of my employees attempted to plow her driveway, unfortunately he was off the driveway and drove on the neighbors lawn. There was damage to the grass and there was a damaged vent pipe. The next day when i was notified by Ms. ****** that her neighbors lawn was damaged I reached out to this neighbor to offer the repair or pay for repair. This neighbors name is Mr K****. we spoke we addressed the situation and it was handled. Mr K**** had no further issue we also agreed that we would repair the grass issue in the spring.  Mr K**** reached out to me in April, and i had the lawn was repaired that week.Ms. ****** wanted to add that there was damage to her driveway. she demanded a full refund and then wanted to have me repair her driveway because according to her my plows have scratched her blacktop. in her texts and complaints to me she pointed out that she had other people clear her driveway ( Back Hoe ) she names 2 separate people cleared her driveway for her but she knows it was my company that did the damage while she says i was never there. I was able to look at her driveway, I did text her to invite her to join me to show me the areas in question. I did see what appeared to be marks (Lines) on the blacktop which i assumed to be from a roller that finishes black top. i called a person that operates such a vehicle to come look at the lines and she would not come outside , she was mad that i didnt make an appointment. The gentlemen that I had inspect the driveway confirmed those lines are from a roller. She was upset and said i didnt bring an actual black top guy. so, I requested a Blacktop professional.  we met at her driveway and once again i let her know we were there. we waited in her driveway for 45 minutes. she asked who i had there and when i told her she was not satisfied , she said he has more lawsuits against him than I do.( BTW I have None )  This 30 + year Blacktop business owner agreed that the lines were in fact done by a finish roller. and after further inspection the angled edge of the driveway leading to the grass on left side of driveway did infact have scratches . The gentleman that inspected it said its not fixable unless you reseal the driveway. and that will cover the scratches But the integrity of the driveway is still intact.   I did offer 1/2 of her money back during this back and forth and she is not accepting . although one of her complaints was i didnt even offer half her money back.  knowing that multiple people were on this driveway there is no way to know who actually did this damage that she is talking about.  I have stopped communicating via text because it is very repetitive. and she has demanded her 100 % refund and resealing her driveway.  she has threatened to go to the news, and contact any other customers i have had in search of someone to complain with her.  Thank You David S****** DS HANDYMEN INC *** *** ****
