    I ordered a package with premier event photography to film my daughters figure skating competition. I have ordered with them twice before and the videos and photos have always been great and had audio attached. I just received the new ordered product which was for a competition on Feb 22nd and many photos were not great, pictures of just my daughters butt (in her figure skating dress) or blurry shots that had my daughter blurry but the audience clear. Then the video comes back with no audio. Called the owner and he claimes it was made.clear on the order form that they changed their rules. I read him the order form over the phone and it is not listed anywhere about no audio being added to the video. Plus the price wasn't cheaper from the last time when audio was added.

    We didn't take a video on purpose bc we were planning on getting the professional video. It is impossible for parents to get good videos because theee is netting and scratched plexi glass blocking the shots. Also because you are up against a flat surface you miss half of the jumps bc the skaters have to go down in a corner of the ice and you cant video. That's why it is so important for to have the video bc the photographers sit ice side from an unobstructed view that no parent or coach is allowed to be at. The photographer is the only one who sits on the side of the judges so they get full foward face. Parents see mostly the side and back with judges faceing us.

    It puts parents in a forced situation where if you want a good photo and video you have to use these people otherwise you are stuck with scratched up missing video shot you can get.

    BBB spoke with Randy at the business who explained that due to copyright restrictions he cannot put audio in with the video. It's is the policy *** ****** *******.

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 
    Copyright issues do not apply because it falls under the fair use guidelines which is part of US Copyright laws. I did not order a video from ** ****** ******* and Premiere Event Photography is not employed by ** ****** *******. I have contacted ** ****** ******* and they have not responded back with anything about copyright issues. Premiere Event Photography is a private business and entered into a contract with me directly. None of the copyright issues were ever addressed or listed on the order form. Under the copyright fair use guidlines there is nothing that states music cannot be added to audio tapes for personal use. This video is not for sale or public use. This video will not go to market and thus not take money away from the original authority thus not violating Copyright. This is a personal video of my daughter bought solely for memories. Same thing as in a wedding video. If I hire a videographer to video my wedding it would be absolutely ridiculous to not have audio. There would be no copyright issues of my guests dancing to music on the dance floor in that video. Especially if the company doesn't specifically say there would be no audio available.It is the assumed that videos will have sound unless otherwise agreed upon in advance. This is the same thing. This video was ordered for personal memories of my daughters achievements and doesn't fall under copyright infringement issues.If the Premiere Event Photography had notified me in advance that they wouldn't provide audio I would have never ordered the video. That's the ultimately issue. They promised to provide something, didn't provide the agreed upon product and is now claiming copyright which has nothing to do with this situation.
