I am writing to formally lodge a complaint against Nixon Sosa Maintenance, **** for significant breaches of contract. On 4/30/2024, we entered into an agreement where the contractor, Nixon ****, was to complete several tasks including painting the bedroom, living room, doors, ceiling, and hallways; changing the mirrors in the bathroom; fixing and painting the front and back gates, windows, and doors; installing a new shed in the backyard; and laying cement in the backyard. The agreed-upon total for these services was $21,500. I have already paid $10,550, which is more than half of the deposit. Despite this, Nixon Sosa Maintenance, **** has failed to complete the work as specified. The tasks left unfinished include painting, gate repairs, and shed and cement installation. He also failed to use a drop cloth while working despite being ask multiple times, which damaged our wooden floors.Attempts to resolve the issue directly with the contractor, Nixon ****, have been unsuccessful. He has refused to complete the work or provide a satisfactory explanation. The situation escalated to the point where the police had to intervene. We were advised to seek resolution through the Better Business Bureau. This situation has caused significant inconvenience and financial strain. I respectfully request that the Better Business Bureau take appropriate action to address this breach and assist in recovering the funds for the incomplete work.

    Business Response

    Date: 09/28/2024

    Dear, Better Business Bureau

I'm ***** ****, owner of Nixon Sosa Maintenance. I apologize for the delayed response to this complaint, as I was out of the country and relocating.

    Background:

********* ****** (****************************************************************) and I entered into a contract for various home improvement services, including:

    1. Painting (living room, doors, ceilings, hallways)
    2. Mirror installation in the bathroom- COMPLETED
    3. Gate and window repairs and painting
    4. Shed installation - COMPLETED
    5. Cement laying

(We never started the painting job and never charged for that because the shed was $17,000 alone and that job was completed.
Due to the cluttered living room, she decided for me to prioritized the shed construction first.

    Dispute:

*** ****** and I verbally agreed that she would cover the cement costs. However, when I requested payment, she refused. I had already paid $1,170 out of pocket for the cement.

I completed the shed construction ($17,000) but ceased further work due to non-payment for the cement.

    *** ****** then:

    1. Called the police, falsely accusing me of physical assault (no police report was filed).
    2. Locked me inside her home with her son restricting my exit.

    Outstanding Issues:

    1. $5,450 balance owed for the shed construction.
    2. Unpaid cement costs ($1,170).

I request resolution and payment for the outstanding balance.

    Sincerely,

    ***** ****
