    In May 2024, I attended my final class at CKO Kickboxing Park Slope, and my account was frozen at my request. I never reactivated my account, yet after 10 months, my AMEX card was charged $145.26. When I reached out to the company for clarification, I was informed that, due to not completing the challenge, I am now bound by a contract for several additional months. This claim is inaccurate, and when I provided the evidence to dispute it, the *** Kickboxing management attempted to justify the charge with a different explanation. Additionally, they admitted there was a glitch in their system, stating this prevented my account from being charged in October 2024even though I never agreed to a reactivation unless I explicitly called to do so. I have requested a refund twice, but both requests have been denied, leaving me no choice but to seek legal advice.The public needs to be aware of how CKO Kickboxing Park Slope treats its clients. I will never do business with this company again, and I am committed to sharing my experience with others

    In response to this complaint: CKO Parkslope facilitated a program, named 16 week FitGainz challenge, in which we provided kickboxing services at our studio. We had no involvement in the contract or billing, as this was managed by the 16 week challenge company. To our knowledge the participant and the company had multiple emails on this contract as it relates to freezing/billing/cancelling etc but we specifically were not involved.  We have contacted the company and they have confirmed that this individual was cancelled and no payments are set to be charged in the future.  As stated, this was and should not be a reflection of our facility as we simply provided the classes but were not in a contract with this individual and/or collected payments from her account

    I joined a gym, ***, in July, 2023. When I signed up, I was told this was for a 3 month membership. Auto-renewal after 3 months was never communicated to me at sign up and I was led to believe the membership would expire after 3 months. I have documentation to prove I only used the gym for those 3 months.I recently found out at the beginning of September 2024, the gym has been charging me ever since October 2023 even though they told me the membership would last only three months. This amounts to around $2,500.I reached out to the gym asking them to refund me but they were uncompromising.Under New York General Business Law GBL 527-a, the business must:a) display the auto-renewal terms in a contrasting font type or color than that of the surrounding text or by using symbols that call attention to the renewal offer language b) notify consumers of an upcoming automatic subscription renewal charge between ***** days before the auto-renewal charge.CKO failed to comply with both of these terms of the law.I saw on ****** and Yelp reviews of multiple people complaining about similar issues regarding deceptive and dishonest billing practices.

    Hello, we are very sorry to hear of this customers dissatisfaction. Upon reviewing their account, we saw that the terms and conditions of the auto-renewal were clearly outlined in the agreement they accepted when they initially signed up for our service. (please see the customers attached agreement to validate this statement) These terms include the automatic renewal of their subscription and the associated charges. The contract clearly states in a separate part how to cancel the subscription so no further payments would be made.  When we heard from this customer we immediately called to address the concerns and offered several months free to compensate for their dissatisfaction, as our policy does not allow for refunds on auto-renewals. 

    In addition, the ****** reviews that the customer has sited is not in regards to our facility.  This was a program that was ran through another service provider in which we were not collecting payments or were the point of contact for cancellations, and merely hosted the challenge.  

    Our business prides itself in our codes of conduct and how we treat our customers.  Please read our reviews for our specific business and none that apply the the 16 week challenge.

    Good afternoon,

    As stated in my initial complaint, CKO informed that I was signing up for only 3 months of membership. They did not show me the contract they later sent to my email. They did not inform me at any time that there was any auto renewal clause. There was never any information provided to inform me that I was signing up for anything more than 3 months of membership.

    Regarding CKO's proposed compensation, they offered only *one* month of free gym compensation, in contrast to their claim of "several months":

    "we can also compensate you with a free month to come back to the gym if you are interested."

    Free months of gym membership are not reasonable forms of compensation:

    1) Free months of gym do not pay my bills or put food on the table

    2) I do not live in ******** anymore and would not be able to use their gym

    The New York law I referred to requires that a business informs the customer between ***** days before the auto renewal is scheduled that auto renewal is about to happen. *** has not answered why they failed to do so or produced any record that they ever did. The law was put into effect precisely to stop businesses like CKO using hidden auto renewal clauses to steal from customers.
