On April 21 2023 I contacted ********************************* licensed # H-***** who is insured by ******************* up to $3,000,000, and owns Legacy brick and Stone ************************************************************************ to get a free estimate for masonary work at my house. He came and gave me a qoute for $146,000. I told him that I will be getting another estimate. He then called me on several occasions harassing me asking me if i would hire him. I declined his services and told him that I found another person that will do the job for $85,000 Installing *****sq ft of pavers. He asked me if I can send him a picture of the qoute and he will see if he can match the price. I sent him a picture and he told me the contractor is not licensed or insured and that i should be hesitant in giving him the job. He also said that he is licensed and insured and the best he can do is $105,000 for everything that we discussed. I said ok we will meet up and go over everything in detail and I will send you a 3d rendering of exactly what i want. On Friday May 19th 2023 he came to my house and took his measurements again and said that he didn't give me a estimate for the front porch and the cultured stone for back and left side of house for the foundation. I said i thought we had a agreement for what i asked over the phone. He said he will have to charge me $15,000 if i wanted that done. I agreed and now the price went up to $120,000. Before I signed the contract I specifically went over the scope of work that i want done to my house, which was roughly ***** square feet of pavers to be installed from backyard, pool area, driveway and front patio. After going over everything in detail and sending him 3d rendering of exactly what i want done to my house, he agreed and said he will do the job for $120,000. I asked ******* when he think the job will be completed because i am hosting a significant family event and i would like the job done in a timely fashion. He said he will start on tuesday 5/30/23 and complete by 6/30/23 weather permitting. ******* writes up the contract I signed it and I gave ******* a check for $12,000 on same day Friday 5/19/23. On Tuesday 5/30/23 was the start date. I gave him a 2nd check for $40,000 He continued to demo the backyard. I noticed that he didn't demo the left side of house up to the first step of basement entrance which we went over the day i signed the contract. He said he wasn't doing it that i never told him that. I said yes i did. We went back and forth and I said I hired you and i am paying you $35,000 more than the original contractor I was going to hire for $85,000 so there wouldn't be any problems or headaches. He said i know but i have to charge you $10,000 more i said i dont have anymore money and that we discussed everything i wanted. He said he would do it for $10,000 i said forget about it. On Wednesday 5/31/22 He came to work and continued demo and removal of concrete. He then calls me saying that his measurements was wrong he went over the scope of work again and did measurements and said that he will be short ***** sq ft. I said that's not my issue. Specifically went over everything I wanted and now your telling me that we are short ***** sq ft. He said he will do it he just has to charge me $15,000. I said no way. I don't have $15,000 extra to give you because you messed up on your measurements. He said he will have to take some sq footage off from some areas. I said we will figure it out but I'm not happy with these problems. On Thursday 6/1/23 and Friday 6/1/23 and Saturday 6/2/23 he didn't show up to work saying he can't do nothing until my plumber and electrician finish there work. I said you can start the demo of the front of the house he said no. He will finish the back then do the front. That didn't sit well with me because we are on a time frame for work to be done. On Monday 6/5/23 He didn't show up for work again and texted me at 9:13 a.m when he was suppose to be working at my house at 7a.m saying that his bobcat isn't working he's waiting on a mechanic to fix it and he will come over to work. At 10:58a.m he texted me saying he needs a new starter and his mechanic is going to install it in 2hours and send me a picture of the bobcat and in the background of the picture you see that he is working at another job site. He never should up to work that day. On Tuesday 6/5/23 he showed up to work and I told him that the backyard will remain the same sq ft of pavers. He then says ok and had material delivered to my house. After the day is done he calls me and said what are we doing with the ***** sq ft of pavers. I said your gonna do the job I hired you to do he said its gonna cost me $15,000 I said I'm not paying you extra money for what I originally hired you to do. He said I dont need no headaches I will give you a detailed invoice and cost and labor for 3days he worked and refund me my money I said ok that's not a problem and then he hung up the phone. 3 hours later he calls me back saying that he wants to work with me and that he will continue to do the job. I said ok fine see you tomorrow morning with ***** who will be doing the pavilion. ***** will mark exactly where he wants the footings to be. ******* said that's not a problem. I gave ************************* number and ******* said he spoke with ***** about the dimensions and will take care of the footings with him. On Wednesday 6/6/23 ************************* and myself discussed exactly where the footings for the pavilion will be and ***** said the dimensions are 2x2x3ft deep. ******* said to ***** that he didn't tell him those dimensions over the phone. ***** said yes he did. ******* became belligerent and loud screaming at Jessi. ***** said why are you screaming at me. ******* said I talk loud and I'm deaf in 1 ear. ******* was very unprofessional and ***** left after he marked where the footings should be for the pavilion. ******* then tell me that he not doing the pavilion anymore because that's not what he discussed with *****. I said that you said you will do the footings now you have a issue with doing it. ******* said he going to have to charge me more money. At that point I realized ******* is going to give me more problems and after his unprofessional display towards ***** i felt threatened and uncomfortable and feared for my safety as well as my kids safety so I told him that I no longer want to him to work at my house no more and that he can send me a detail list and receipt for all materials and 3 days of labor and deduct the $52,000 I gave him and refund me my money. On Thursday 6/7/23 I continued texting Stew asking for my money he said he will be back to complete the job. I said I don't want you back your fired I don't want you to continue working at my house. He replied saying unless I want to pay a 4 week void in his calendar I should let him continue to do the work. I said to Stew We have a contract and you only worked 3 days and you want to charge me more money for the work that we discussed prior to me signing the contract that you refuse to do unless I pay you more money which I am not. A 4 week void in ******* work calendar is him asking for more money. Which is what he has been doing from the moment I signed the contract with him. On Friday 6/8/23 I sent ******* a text stating "Good afternoon Stew, I have not received a invoice for the work you did and my refund for what I paid you and would like to know when will you be giving me back my money?" He didn't reply. On Monday 6/12/23 I hired *********************** and ******************* to see how I can collect my money. Tuesday 6/13/23 ******* contacts ******************* and said he will refund me back $20,000. which is disrespectful. He didn't do $32,000 worth of work and material cost don't add up to that amount. He didn't give any receipt he just made a list up which still doesn't add up He then comes to my house at 11:05 a.m unannounced no call or text after I told him several times to not come to my house. He is trespassing and im in fear for my safety and the safety of my family I have cameras and video to show. On Tuesday 6/13/23 at 7p.m I received a email from Stew which says the scope of work he did which I don't agree and he still hasn't sent me receipts for material he purchased. He also states he has equipment at my house. The cameras show him coming to my house and leaving with his belongings. I don't have his tools or whatever else he is claiming is at my house and I don't want him coming to my house again. I have more than enough evidence between video and text messages and contract. At this point my counter offer to his ridiculous offer of $20,000 will be $40,000 because of my time taking off of my work schedule pain and suffering and having to hire a new contractor which cost me more money and having to reschedule my significant family event. He can keep the $12,000 down payment for the material he purchased without showing any receipt and Labor for the 3 days he actually came to work. I work very hard to save my money and provide a lifestyle for my family. I will not be getting robbed by a crooked contractor for $32,000. I am willing to go to court if he doesn't give me back my hard earned money.
