      Dear Sir or Madam:

      I am hoping the BBB can assist me with a problem I have encountered with Mario & Son Tile. Please refer to the attached letter. I contracted with them for $11K for a retiling of a bathroom shower and paid $6K upfront. There is dispute regarding the remaining bill as we did not perform some services in the quote. They've reduce the bill for materials but have not considered labor and are refusing to issue me credit where I believe I'm due. Thank you for any assistance you can provide, I really appreciate it.       We have received word from the customer that they would be sending in partial payment, and we should receive it by September 1st.  I would like to confirm what we receive first from them before we continue this process.  I will be responding again next week once payment has been received.  Thank You

      I needed work done in my bathroom so I called mario and son tiles from ********** ** ************ ** ***** tele#***** ********
      Fora estimated quote.i then stopped at the business to go over the estimated quote price and I agreed to the price and when I picked the style flooring I wanted and we both when over the entire contract the price when up we both agreed I agreed to the price and we both sign the contract with the down payment and the starting date the closing contract price was 6,150.00 dollars close to the end of the unfinished project they wanted more money they wanted another 650.00 more butting me in a position to borrow more money from my credit card creditors I then discuss this with the manager from the bank I bank at and she said that once you signed a contract you can not be charged over that contract and that's exactly what they did and this is why I need your help to get my 650.00 dollar back to return it to my credit card creditors.

      We have attached a copy of the charge to Mrs. ***** for electric to be completed which was originally $750.00.  Mrs. ***** requested some additional electric not on signed work scope to be done on her jacuzzi while the electrician was out there.  The bill came in and we asked for a discount from the electrician, and he obliged and discounted the bill to $1400.00 (see attached).  Therefore, the difference of $650.00 was for the added-on work from the electrician for the jacuzzi that Mrs. ***** requested.  Ms. ***** did not have any problem paying this since it was a add on as per her request.  Also, she has since contacted just recently for more work to be done by our company.  Therefore, we are a bit confused as to why she is questioning this now after six months because someone gave her false information.  We most certainly can add or even subtract from signed contracts if the scope of work to be done changes in any way after we start a job.  There are many times people eliminate items they thought they originally wanted, and we have to credit them.  In this case this was an add on requested and as you can see, we did not make a penny on it. We simply charged her exactly what the electrician charged us.  1,400.00-750.00=$650.00

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.


      I,* ***** disagreed with the company decision, I nevertheless asked for anything added on the reason why the electrical guy was asked to come out was because his job didn't meet the electrical code he ran a direct wire with no switch and I asked for it to be done properly everything that I wanted done was written on the contract that we both agreed on before   they started the project Totalling to 6150.00 and that was only thing I agreed on that extra was unexpectedly and they put me in a position of given them more I have pictures of the electrical to help with my complaint they need to admit that they broke the contract and I feel they need to return the 650.00

      Our electrician was contacted to install a new exhaust fan only as per typed quote submitted in our first response.  When Mrs. ***** came in to sign, she asked for a new switch only for jacuzzi to be done while there and this was not priced into job.  The jacuzzi was previously installed by someone else not Mario's Tile.  When our electrician was there to install the switch additionally requested by Mrs. Lopez, he discovered it was not done to code. Therefore, it was explained to Mrs. ***** and verbally agreed to additional charges to correct the faulty install done by previous jacuzzi install.  Because the previous installer did not install this jacuzzi correctly and to code, our electrician had to do a lot more than just a switch which was originally requested. The bill from our electrician clearly shows a 20AMP circuit GFI Breaker needed to bring it to code before the switch could be added. A simple switch requested by Mrs. ***** installed would not have been to code and correct.

      We did not make a dime and the customer was charged exactly what we were charged. Mrs. ***** can't expect us to pay for the additional $650.00 to fix and bring to code her originally faulty installed jacuzzi? This entire $650.00 charge should be directed to the previous installer who did it incorrectly, since she had to pay for something done wrong by him, not us. We feel strongly that Mrs. ***** is going after the wrong company to get her money reimbursed. In her response she stated "he ran a direct wire with no switch" which is a faulty statement.  This should be in reference to her installer, not our electrician.  Our electrician was trying to fix and bring to code everything that was already there and wrong.
