I contracted with this company on Sept 20,2022 to remove 4 trees & grind out stump of 1 of them. I traded him my camper as well as paid cash for the job. He subcontracted to another company to do the work. Partial tops of 2 trees as well as top 1/2 of a Maple were completed. Joshua did not finish paying the company to finish the job, & then he kept telling me he would have the job done by my deadline of Oct 14. When he did NOT finish it, he told me by Oct 21. The other company told me they would do the work if Joshua did not pay them, but I had to pay the other company. The other company came on Oct 21, set up their equipment, then came back today, Oct 22 to finish the job. After they got started, I was told Josh did NOT come through with payment & this company made out a contract/receipt for discounted price for me to pay them to finish job. Plus I have paid $ to have most of the limbs left here for over 2 weeks, cut up, plus my husband cleaned our driveway & neighbors driveway. We have also had to take our pool & chain link fence down to accommodate the bucket truck in our backyard.

    Business Response

Called business and this was relay:

The consumer probably sent you everything on the contract except the back of it. She paid the 3rd party contractor when I advised her not to.  I told her I had already paid them.  It is not my fault that she did it anyway.  I paid them in full and they charged her additional and she paid it.  I even asked her to call the police while I was there to file a report and she declined.  I have nothing to do with this.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]
He is LYING about paying the other contractor in full. He told me he had the rest of the third-party contractor's money to pay them when I contacted him about the other contractor informing me he was not paid in full & cannot continue work until he gets paid. Joshua contacted me on Oct 25 & offered to bring my camper back & call it even on Thur Oct 27.4 days after he was supposed to be bring it back, Oct 31, he texted me & told me he thought we should both file a police report against the other party. He NEVER asked me to call police in my presence. In fact, the only 3 times I have even seen Joshua in person were when he was here to estimate the project, a few days later when he came to get the cash & collect the camper (he took my copy of contract back), then the first day the other contractor was here to start the work, Joshua was here to help the contractor & I made him give me back my copy of the contract. He also misrepresented himself saying the other contractor was his "crew" when in reality Joshua SUBCONTRACTED to the other party. The back side of his contract does state 50% deposit is nonrefundable, then other 50% is due on completion of job. Joshua demanded ALL the cash up front as well as the camper. There was NO 50% deposit. The only reason I was forced to pay the other contractor was because he was not going to finish the work if I did not pay him because Joshua did NOT finish paying him. Now Joshua is threatening to sue me!! I have filed a complaint with Debt Collectors International. They have all the texts I still have from Joshua as well as the other contractor. This is not the first time Joshua has not fulfilled his contract & refused a partial refund. All I was asking for is my camper back or $2600 I had to pay the other contractor to finish the job. I was not asking for a FULL refund. If you need the text messages, Iwill figure out how to send them.

    Regards,

    Michele Rolfe
