    We first met Mr. Matthew P****, dba LP3 Construction, at our property on or around July 22, 2022, and we indicated to him that we would like to use his services to build a pole barn in 2023. I then spoke with Mr. P**** via phone on September 27, 2022 and I confirmed with him that he would still be able to build the pole barn for us in spring/summer of 2023.
    In April 2023, Mr. P**** came to our property along with the excavator and spoke with my husband and I regarding the building of the pole barn, including dimensions, color, doors, windows, etc. Mr. P**** shook my husband's hand as a gentlemen’s agreement to build the pole barn for us. On April 21, 2023 we wrote Mr. P**** a check in the amount of $7,500.00 which he indicated to us was to pay for the trusses for the pole barn. Mr. P**** also discussed with my husband and I that he would obtain the permit for the pole barn and even provided us with the drawings he made for the pole barn to be submitted to the code officer.
    On July 6, 2023 I called and spoke with Mr. P**** on the phone to find out a date when he would start work on the pole barn since we had not heard anything from him in almost 3 months. Mr. P**** told me that he would start work the last week of July or the first week of August.
    On August 4, 2023 I sent Mr. P**** a text message for an update on when the work would begin on the pole barn since I hadn’t heard from him. His message stated that he kept getting pushed back due to the weather but that he should have the current job he was working on done by the end of the next week, which would have been August 11, 2023, and then our pole barn build was next in line. We waited until Monday, August 14, 2023 and when we hadn't heard from him by 4:48 p.m. that afternoon, my husband called and left Mr. P**** a voice message to please call regarding when he would come to begin work on the pole barn.
    On Tuesday, August 15, 2023 at 9:39 a.m. my husband again called Mr. P**** after no response and left another voicemail message indicating that we were now concerned as Mr. P**** was not answering his phone nor returning our phone calls and had not shown up to do the work.
    On Tuesday, August 15, 2023 at 5:40 p.m. I sent Mr. P**** a text message indicating that my husband had called twice and left messages for him but my husband had not received a return call. I also asked Mr. P**** for a start date for the pole barn build. Mr. P**** did not reply to my text message. My husband called Mr. P**** yet again and left another message on Wednesday, August 16, 2023 at 9:35 a.m. indicating our deep concern about the pole barn build not being started and that we had not heard from him and my husband also asked Mr. P**** for a date that the pole barn build work would begin.
    We were more than patient and understanding that the weather could cause a delay
    but Mr. P**** avoided our phone calls and text messages and refused to give us a start date. I finally got a reply from Mr. P**** via ******** messenger when I left a negative review on his ******** page, which was promptly removed by Mr. P****. In his messages, he gave us more excuses and stated he would return our $7,500.00. When I realized that Mr. P**** had no intention of coming to do the work, I contacted the code officer and found out that Mr. P**** never submitted paperwork to obtain the required permit from the code office to begin work on the pole barn. He would not have been able to begin work on the pole barn as he said he was going to do without the permit. I also asked Mr. P**** for proof that he purchased the trusses with the $7,500.00 we gave him, but he refused.
    As retired senior citizens, we live on a fixed income. Mr. P**** took our $7,500.00 and will not return it. Mr. P**** had built other pole barns in the area under the name ******* ***** ************ and we had no reason to believe he would take our money and never return to do the work.
    We just want our money back.
