    Contacted N.E. BRETHERTON SOIL & STONE in good faith to do some work in our back yard removal of an old shed and laying stone to for a new shed the vendor ask for a deposit and we paid in cash expected job to start on 9/21/2023 contacted us that they could not make it rescheduled to 9/25/2023 between 930am & 10am no show have tried to contact several times without any resolution we want a full refund

    Found N.E. Bretherton Soil and Stone on Facebook with photos of the work they have done for drainage etc. I messaged Nick (owner) on 3/15/22 asking for a quote for drainage.Nick came out on 3/19 at 1 p.m. and provided us with a quote on March 19th through messenger of $4250 stating he needed half down when we sign the contract of $2125.We paid Nick the half payment on 3/24.I repeatedly messaged Nick to confirm the date he would start the drainage.Our contract stated the drainage would start on 5/9.Nick did not show,I sent several messages to get him to lock into a date.He then stated that he would be at our house on 5/26 between 1-2 to start the drainage. On 6/2 he messaged that the yard was "rough graded the best he could" and that he wanted to pick up the 2nd payment.When I returned home from work, the yard was in rough shape (i.e. branches, logs and roots pointing out of the ground and the drain boxes were placed above the ground.")I called him expressing my concerns with the condition of the yard, he became agitated then demanded that we pay him the remaining amount.I explained that the job was not done, so the payment is not due yet.I expressed concerns about the drain boxes being placed 1-2 inches above ground level and the location of the drain boxes were not where we previously discussed; these were all red flags for me and the reason I decided to dig up the area where the pipe was supposed to connect to exit the yard.When I dug down, there was no pipe.Nick half dug a trench and then reburied it claiming the piping was connected.I immediately called him (still same day 6/2),took picture/videos of the "work" he did.When I called him he stated,"I know what this looks like, it was a mistake,I will be back tomorrow and make it right,you don't have to pay me now then until it is completely finished."Nick came back a few days later,shoved 1 more section of 4 inch pipe in stated he would be back after getting diff. equipment.Never came back,blocked all calls etc.
