    Business Response

    Date: 11/15/2024

We did install an egress window for **** *****.  We had an issue with water intrusion.  The customer called us and we responded.  We sent a crew to his house and worked to resolve the issue.  We even took a carpet cleaner there twice to shampoo the carpet in the basement.  He later called us to inform us that he had gotten water in his basement again, but that the water was NOT coming in from the egress window but down at the floor.  We went back over to investigate and found that the carpet edge (out about 2" was damp) but that in fact that the water was not coming in from the window.

We explained to him that water at the floor but not at the window was as a result of the fact that his foundation had never been properly coated with the bituminous coating as is required by building code and departments and also that the rear yard was sloped toward his foundation the entire length of the rear of his house.  There was also a sink hole from ground settling after our work was completed.  We offered to go over and bring top soil with us to address the sink hole and to create a swale out away from the house to try and prevent all the rain water from being us against the house.

We said, "No, that is not acceptable".  He demanded that we dig up the foundation to find where the water was coming in.  We again tried to explain to him what was causing the water intrusion down at the footing of the foundation as opposed to at our window well, but he was adamant.

He claimed he had never had a water problem before we were there but he had a dehumidifier in that area, obviously because there was in fact a moisture/water issue.

We also reviewed this situation with an engineer who confirmed to us that based on the pictures we had of the house, showing the foundation had not been coated and the ground sloped to the house that our diagnosis was in fact correct.

He claims to have hired another contractor to work on it and insisted we pay for it.  He claimed to have pictures and an invoice from that contractor.  We told him to forward the pictures and a "detailed" invoice so we could see what was done, and if in fact the water was as a result of our work we would certainly reimburse him for it, but we would not pay for any other foundation or grading issues.
