Vendor failed to show up on scheduled date. Vendor’s failure to show up on scheduled date resulted in changed circumstances. I asked if we could reschedule for a later date due to changed circumstances caused by their no show. Vendor instead sought to charge me for the rescheduling delays they caused. Vendor further advised they would charge me more for the changed circumstances also caused by their failure to show up on the scheduled date. I asked they cancel the contract and refund my deposit, which was $2,160 (nearly half the amount of the paint job). They kept my deposit and said they will not refund it. They breached the contract and delivered no services and kept my money. This is terrible business and I needed that money to actually paint my garage. My fear is that this business is going that to many others as well. Please help me get my money back and/or warn others.

    Business Response

We respectfully but firmly reject the claims made in this complaint, which are misleading, inaccurate, and damaging to our company’s professional reputation. The client was referred to us by realtor **** **** ******. We provided a full project estimate free of charge, despite our standard $40 consultation fee, as a professional courtesy. The client proceeded to sign a written contract, which included our nonrefundable deposit policy (Section 4). A deposit of $2,160 was paid to secure a multi-day interior painting project scheduled to begin on Saturday, June 1, 2025—a date confirmed and agreed upon in writing. The realtor originally asked when we could start, as the home was closing on Wednesday. Due to a shift in our internal schedule, we offered—voluntarily—to begin two days earlier, Thursday, May 30. This was not an obligation; it was an accommodation extended in good faith. Shortly afterward, we were made aware of a contractor emergency, and we immediately communicated with the client that we would return to the originally scheduled Saturday start. At that time, the customer then disclosed that movers were arriving Friday and items would be stored in the garage, which created concerns over access and space. This was not disclosed at any point earlier, and had we arrived On the earlier day requested or tomorrow as Planned, there would have been clear site conflicts. Ironically, not arriving On the request requested early day prevented a site dispute and further confusion. We never canceled the project. We remained ready and able to perform all agreed-upon work on the original date. The client, however, sent a direct message saying, “Let’s just call it quits for now and refund my deposit,” and attempted to cancel the agreement—despite no fault or breach on our part. The client’s reason for cancellation is directly tied to their own overlapping move-in schedule, not any failure by our company. We then explained our standard company policies: Deposits are nonrefundable, as they secure labor, time, and calendar commitments. We offered two solutions: A daily rescheduling hold fee ($25/day), or A halfway payment to reschedule without fees. These were offered in writing, calmly, and professionally. It’s important to note: -The customer received a free estimate. We made scheduling accommodations. We communicated clearly, documented everything, and responded professionally at all times. -The customer unilaterally canceled and is now trying to reverse that decision based on personal preference and frustration—not because of service failure. -Additionally, the realtor then contacted us repeatedly, escalating the matter emotionally and misrepresenting our actions. The complainant, who identified himself as a lawyer, made comments suggesting legal action and refund demands—implying pressure tactics. We take this seriously, and would like to point out that a licensed attorney understands the validity of contracts, and the legal enforceability of a signed, agreed-upon deposit clause. This was not hidden—it was agreed to, documented, and honored. To be clear: -We did not breach our contract. -We did not fail to show up on the scheduled project date. -We did not refuse service. -We did not miscommunicate. -We are still willing to perform the work. -The client chose to cancel and is now attempting to reframe the narrative to seek a refund that is contractually not owed. We stand by our policies and our integrity. We a Legitimate business that serves homeowners,  commercial and luxury clients throughout the region and beyond with consistent professionalism. Should BBB require supporting documentation, we are happy to provide: -The signed contract -Screenshots of all communications (client and realtor) -Proof of cancellation by the client -Proof of our alternative solutions offered -A detailed timeline of all outreach efforts on our part We respectfully request that this complaint be dismissed and closed as resolved in our favor, as we have fulfilled all obligations, operated in full compliance with our contract, and remained professional throughout.

    Customer Answer

    Date: 05/30/2025

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.

The document provided is an estimate. There are no scheduled dates in writing. The realtor who referred them to me stated she did not represent that the premises would be vacant nor that they inquired as to same. If that was a mistake, the estimate should be void as there would have been no meeting of the minds and my payment should be returned to me.  Any “pressure tactics” were driven first and foremost by the vendor, who refused to simply reschedule the work per my request and instead immediately in a legal like fashion cited in a lengthy response (that looked like **********) a term in the estimate that the deposit is non-refundable and “offered” to reschedule me at my expense. This is simple - they failed to show up when agreed and sought to charge me for any rescheduling. All I wanted was to reschedule the job, just not at my expense since the need for rescheduling had been caused by them. Instead, I get an unreasonable and aggressive response cloaked in “polite” language offering to reschedule me for additional charges and refusing to simply cancel the contract in light of the changed circumstances (in the middle of a move) and return my $2,160 deposit. This results in a forfeiture for me and a windfall for them - based on an estimate for services never performed. Their failure to show up, their handling of the matter after my request to reschedule, and their refusal to return my deposit caused me great distress while in the middle of a move and gave me serious concerns about doing any  business with them. Their response to this complaint confirms my concerns. Please let me know if you need anything further from me. Thanks for your assistance. Regards, ******* *****
