I submitted a bid on Auctions International in error, on a property known as **** ****** *** *** ***** I quickly realized I had made a mistake(30 sec after I made bid) and this was not the property I thought I was looking at. (I have poor eye sight and have a hard time seeing things up close) I searched the site to try and find a way to delete my bid but found noway to do it. I called the Company Auctions International and talked to Amy who laughed at the issue and said you are buying it! and she would not cancel the bid. Please note this was done hours before the Auction was to end and as of writing this the auction id still going on.Business Response

Thank you for the opportunity to respond to the complaint submitted regarding a bid placed on our auction platform for Lot #***** **** ****** ***.The individual states that they placed a bid in error and attempted to have it canceled shortly thereafter. We appreciate their concern and would like to provide the following clarification:Bid Placement Responsibility: All registered bidders on our platform must agree to our Terms and Conditions before placing a bid. These terms clearly state that all bids are legally binding and cannot be retracted once submitted. This policy is in place to ensure fairness to all participants and to maintain the integrity of the auction process.System Limitations: Our website does not allow bidders to delete or retract bids after submission. This is disclosed in our terms and on the bidding interface.Timeline: The bidder contacted us after submitting the bid, but the request was not made immediately—by our records, several minutes had passed. While the auction was still live at the time, our policy remains consistent in such cases, and we are unable to remove bids simply because the bidder had second thoughts.Allegation of Unprofessional Conduct: I can confirm that I informed the caller of the company's policy regarding bid cancellations, consistent with our posted terms. If the bidder interpreted the conversation as dismissive, I regret that impression. The caller kept insisting that we had to do something to fix this and demanded we remove his bid.Outcome: Ultimately, the bidder was outbid before the auction concluded and is therefore not responsible for purchasing the property. No financial obligation resulted from the bid in question.We understand that mistakes happen and sympathize with the bidder’s difficulty, but our role is to enforce the rules equally for all participants. Allowing bid withdrawals in violation of our terms would undermine the fairness of the auction and potentially harm sellers and other bidders.Please let us know if further clarification is needed.Initial Complaint

On 12/15/2023 i was the winning/high bidder on an item. The item was not listed with a reserve but the auction company refuses to let me proceed with the purchase. The terms listed in the ad clearly state all sales are final. I have previously been the high bidder of an item with this auction and they would not honor the sale that time either. They actually came back with a counter offer after i had won the auction trying to get me to pay more money. No where in the terms listed on the item i won did it say they have the option to not sell the item. The terms of sale basically say they can flat out lie about the item and they assume no responsibility for any misrepresentation and you still have to honor your bid. All Sales Are Final!! The auction company should be responsible for honoring the sale.Business Response

Per #6 in our User Agreement, which all bidders must agree to in order to place bids: 6) All items listed on ***************************** are sold 'Subject to Seller Approval' after the auctions close. Sellers that consign merchandise to our auctions reserve the right to accept or decline bids after the auction has concluded. Members can check the approval status of auctions they have participated in by visiting the 'Past Prices' page the day after the auction has ended. Declined bids will be indicated on the 'Past Prices' page, and the minimum amount required to sell the declined item will be shown (if applicable).The consignor, who was within his rights to do so, declined the bids on his auction items. They are an on line only web site selling equipment for The Town of Plattsburgh, New York. Contact there is Greg B****** @ ###-###-####
Item I bought through the site, a tow behind air compressor, was described by Greg B****** as in operating condition and I paid for it utilizing this description. Upon pick up, the next day, I was not allowed to confirm its condition. I confirmed the compressor was faulty the following day, utilizing my own air tools at my shop, and tried to remedy with both Greg and Amy that immediate next business week. (2 days ) I advised Greg the unit was faulty, and I would bring it back for a full refund. After he conferred with Amy, over the next few days, they both decided to deny any possible return.
Both of these folks point fingers at the other with no remedy for me.
This Auctions International site is heavily weighted in favor of themselves and the seller both with little to no opportunity to resolve any falsehoods in product claims and or descriptions.
I have contacted them both a total of 8 times with no considerations made to remedy.
I do have all documentation and receipts for the transaction.
Please advise me of anything else you might need from me, or of any actions you plan to take with these other two entities. Thank you!Business Response

We auction surplus items on our website, *****************************, for sellers who consign their items to be sold. We make every attempt to inform buyers about the risks when buying at auction. It is listed throughout our listings, terms, and descriptions that everything is as-is, where-is and that bidders are encouraged to inspect their purchases prior to bidding. The seller sends us the information for the listing and we post it with the information given. We do not verify it, leaving that responsibility up to the bidders. We list the items 14 days and include a contact name and phone number for bidders to call to make arrangement to inspect the auction items before bidding. I have attached a copy of the actual auction listing for the compressor and a copy of our User Agreement. In order to place a bid, bidders must agree to the terms first.The bidder did not inspect the compressor before bidding. He won the bid, paid for the compressor, and removed it from the seller's facility. Per our terms: Any claim for misdescription must be made prior to removal of the property. If Consignor confirms that the property does not conform to the description, Consignor will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property. This way, if there's an issue with an item, the seller wouldn't be able to place blame on the buyer because the item never left their facility. For these reasons, we are unable to refund the buyer.Customer Answer

For your reference, details of the offer I reviewed appear below.My complaint is born from the combined efforts from both the seller and the sellers agents to impede any reasonable solution to remedy a wrongfully advertised item. In other stronger words, the seller knew how to circumnavigate his items condition statement through the his agents terms and conditions policies. AKA. Advertise junk as operable, not be there for testing as scheduled, and hope the buyer takes the equipment anyway knowing his selling agent will provide plenty of roadblocks prohibiting its return.
