I am filing a complaint a contractor company: ********************** homes . For threatening to put a lien on my house, overcharging , refusing to give full credit towards a siding that was part of the contract and attempting deposit a check that was unauthorized leading to a bounce check due to insufficient funds in a large amount that was not authorized to take. 1. ** ********************** was hired to do a 2 story addition to my house in which siding was part of the contract to supply the same as the existing home. ** **********************, decided to get a siding that does not match my home and refused to get the correct siding because his supplier does not carry my house siding. He then claimed that my existing siding doesn't exist and told me he will use what his supplier has that matches closest to my siding. I took the initiative to search for my exact siding which is also noted on my existing siding called "******* Slate" and purchased it for him to have it placed on my house. He first Said he will give me credit for the siding but then took it back once he got upset. The siding costed me $1893.17. He eventually only gave credit for $1000. After several pleas for full credit. I will attach my recipe and his credit he gave. 2. ** ********************** requested for his draw 5 payments of $12500 on December 1st , and I gave him a personal check of $12500 but accidentally signed the back of the check. So he requested for another check of$12500. I told him to please discard the first check and deposit the 2nd check, that didn't have my signature on the back of the check. ** ********************** decided to deposit both checks cause there to be a bounce in checks due to insufficient funds because my amount he deposited was $25, 000 instead of $12,000 which was authorized. $25,000 was never authorized . Now he is charging me bounce check fees on both checks of $20 each. I will attach this record.** **********************, has charged me late fee on draw 5 and the final balance when he has not completed his job. He has yet to put moldings on my house and is demanding his final balance with late fees in the amount of $275 along with bounce check of $40. A total of *$315 of over charges. He also owe use a total of *$1893.17 for full credit on siding.3. He had created a wrong open for my foundation access that is not part of the floor plan and has charged me $500 to have it corrected. He did not make accurate measurements of studs before purchasing them and has charged me $600 for changing the studs to the correct size. We contracted Pironi Homes to demo and build a new construction home in ****************, **. We took ownership of the home in August of 2021. The builder/homeowner relationship started going south after a tropical storm led to concerning levels of floods and leaks in the new home construction (August 20, 2021). Pironi Homes (contractor) did make attempts to remedy the leak issues. However, all repairs have been unsuccessful in rectifying the leaks. Pironi Homes had last been on-site at the property November 18, 2022 to perform a water leak test with window manufacturer, Pella. ***** concluded that the water was coming into the house from the rough opening and that their windows were not defective. Pironi Homes had since ceased all communication with us (the homeowners) since the day of the water leak test. We continue to experience leaking windows to present date.Business Response

We appreciate the urgency of the situation. The client had gone many months without compliant or issue after we closed out our contract on the house. Concerning the issue at hand, We have made many attempts to identify and rectify the issue. Please see the following attachments, including job logs documenting dates of heavy wind driven rainfall storms with no contact from the client complaining of any leaks, including one time where we were there day after a rain fall where we attempted to fix the issue and there was no visual area of water damage once all siding was removed, the raw wood was not wet to the touch anyplace around the window where the clients claim water enters,further the client was present at the time and visually saw the wood as well and acknowledged no visual water defects around the windows in question.Attached, you will also find Town of North Hempstead sign offs from all building inspections of the building department official showing inspection passes and final building inspection pass as well as the final certificate of occupancy confirming from the Town that the house was completed according to all building standards, you can also find pictures of Pironi Homes doing work on the home to attempt to rectify and identify the issue after closing and after certificate of occupancy, lastly, you can find the final punch list with completed sign offs from the clients 12 days after they claim the leaks began which doesnt show any mention of window leaks that they claim happened, in the statement that the client left on the compliant to the BBB they claim that the leaking began Aug 20th 2021 which is before the date of this final sign off of the Final Punch List on Sept. 1, 2021. Why would the client sign off on the final punch list with no mention of the window leaks after they supposedly experienced issues with the leaks? A copy of the sign off is attached with certification from DocuSign.
We consider as all proof of Pironi Homes attempting to rectify the issue in good faith and after the home was out of warranty and all this work was done at no additional cost to the client and after the warranty expiration. Additionally, this shows that the town, the governing municipality of the building code, had done inspections throughout the building process and approved the home to be up to all building standards and codes. Further, the home had undergone a HERS rating as a new home and for a final *** HERS certification a Blower Door Test is done which tests the home for any Exterior intrusion into the home that would ****** the building envelope. This test was done on 7/20/2021, before the supposed leaks began, by a ************** Certified HERS inspector hired directly from the homeowner not Pironi Homes, essentially an outside contractor not within Pironi Homes oversight. The *** Certified inspector passed and certified the home with no defects and no intrusion of the building envelope from the exterior. Further proof that a leak is not possible. This certification can be found in the attachments, A certificate of occupancy cannot be issued without this certification.Customer Answer

All communication is supported via email attachments and negates the other Party's claim that "The client had gone many months without complaint or issue after we closed out our contract on the house"
We, the homeowners, are not disputing that Pironi homes had made attempts to identify and rectify the issue.
However, in spite of Pironi Homes physically attending the issue, the house leaks persists.
We, the homeowners, have seeked subject matter expert opinion from 3 contractors on the leak issue.
All have identified the problem as an issue with window and siding installation performed by contractor, Pironi Homes.
Pella Window, manufacturer of windows at the property, provided a written statement that the water leak was coming into the house from the rough opening below the trim.
Pella confirmed that no water infiltration was due to product (Pella window) failure. This information was also shared with Pironi Homes.
Based on the opinions of the contractors and Pella windows, we have concluded that the leak issue stems from improper installation executed by Pironi Homes.
Therefore, Pironi Home is responsible for correcting leak issues and repairing any home damage that resulted from the house leaks.
