On November 2 & 3, 2023, I provided JW Forestry $1050 as a 50% down payment to cut down trees at ************************** in **************************. I had initially contacted JW in April 2023. *** came out and looked at the job and then ghosted me for 6 months. I was able to re-engage them in October 2023, at which point they gave me a $2100 quote for the job. After a few weeks I contacted them again to try and proceed and received zelle instructions on November 2 and proceeded to transfer the 50% down payment. They were to contact my tenant to schedule the date of work. After a week went by with no further contact and no scheduling of the work with either me or my tenant, I contacted *** and let him know that since he seemed to be over extended again I found someone else to do the job and asked for my refund back. Over text *** told me that the deposit was nonrefundable and I reached out by phone to talk through the matter with the aim to resolve amicably. When I said, he wasn't owed the deposit, he responded that the paperwork says its not refundable. When I said I never signed any paperwork he said it doesn't matter, transferring the funds is all that counts and his lawyer has been winning this for the past 20 year. When I asked 'so you've been keeping peoples deposits for 20 years without doing the work' , he hung up on me. I was able to find another company who started the work on Thursday November 9th and finished on November 10th. *** kept trying to get me to cancel the other company, and I told him it was too late and the job was done. I was wrong about that- as the replacement company thought they would get the job done in the same day. However they had already started and it was too late to cancel them and give the job to JW forestry.*** visited the property on the night of the 2nd (and sent me photos) and I just learned today that he also visited on Saturday the 4th from the office manager *****. This behavior is bothersome and feels threatening.
