    In late autumn of 2021, Almstead sent me a bill for $2270.95, which I paid by check number **** on December 22, 2021. The check was cashed. Despite this check having been cashed, Almstead continued to send me bills that included the amount already paid. Over the course of the past two years, I have asked Almstead to check their billing records and send me a revised invoice. I sent a copy of the cashed check to Almstead several times. This correspondence included e-mails to the owner, *** Almstead. More to the point, I corresponded, by e-mail and by phone, with four successive employees in the accounting department - **********************, ***********************, *********************** and *******************, each of whom said they would follow up. None of them has done so over a period of two full years. The most recent unadjusted invoice was received only last week.

    At this time, I have been contacted directly by Almstead Tree & Shrub Care Company, LLC regarding complaint ID ********, however my complaint has NOT been resolved because:

    I do not know whether Almstead e-mailed me due to my filing of this complaint.  However, after almost two years - too late for me to file a claim with my bank - they have now informed me that they never received or deposited my check.  The check was deposited and debited from my account, so I am following up with my bank. I think Almstead should follow up on its own, as it seems highly unlikely that the post office would have delivered my check to anyone else, and other checks I sent to Almstead were in fact received and cashed.  So I suspect the problem is at Almstead's end.    [Your Answer Here]

    Per the attached email ***************************** check never made it to us and her bank paid it to the another party and not the endorser i.e. Almstead Tree & Shrub Care Company. How can we be responsible for a check we never received and ********** paid to the wrong party? We have assisted ********************** where we could and offered her statements from us in her pursuit of the bank causing the issue.

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    Based on its handling of this matter for over a year, I have strong reason to believe that the check was received and illegally deposited by a former employee of Almstead Tree.  I continue to investigate but it would be helpful if Almstead tree responded to my inquiry about why the former billing staff, in particular ******** Judge, never responded to my timely inquiries.  [Your Answer Here]
