      I purchased a Simply Down comforter that turned out to be defective (feathers leaking everywhere after only using a few days), and they refused to do anything to help me recoup any portion of the $2500 I paid. The leaked feathers clumped allover my bedroom floor, attracted dust mites, and resulted in a severe allergic reaction that almost sent me to the *** I understand that their policy is that comforters are final sale, but they should stand behind the products they sell and make exceptions for extreme cases like this, when there is a clear defect. I actually talked to the owner of Simply Down, *****************************, who was rude and not helpful. She kept insisting they dont sell defective items, but I dont get how anyone can be so arrogant to assert a defect is impossible when even the most reputable retailers acknowledge that defects happen sometimes and offer customers fair solutions. Im extremely disappointed in this comforter, which was ridiculously overpriced for the quality I received, and the shady business practices of this horrible woman.

Licensed ni ******************** Via First Class Mail June 18, 2024 *************************** ********************************************* RE: SIMPLY DOWN ***** et al vs. *********************** Defamation Dear ************:****************************************** :T ************ E: ********************* Please be advised that this office represents SIMPLY DOWN **** ("Simply Down") and ***************************** ("******************") as representative and owner of Simply Down to pursue immediate legal action for pecuniary and injunctive relief arising out of your slanderous, and harassing conduct. Please note that unless you immediately correct your actions, our clients wil take legal action against you. You are hereby ordered to cease and desist from your unlawful conduct, as described below.We understand that on February 17, 2024, you purchased a "Bliss" down comforter size king from ***************** via the vendor Simply Down (collectively "The Store"). We further understand that as part of your purchase you were provided with a copy of The Store's return policy, which explicitly states that "Returns after 31 days are not accepted."We have been informed that on May 30, 2024, you contacted ****************** via email correspondence in which you voiced your alleged concerns and sought a replacement of the comforter. Your email was more than three (3) months after your purchase, and you sought relief contrary ot hte return policy of The Store. Nevertheless, that same day, ****************** replied ot your email and advised that she was willing to resolve the issue for you -despite The Store's solid return policy. To date, you have failed ot respond ot ********************** email correspondence, despite her willingness to accommodate you. We have been further informed that on May 31, 2024, you brought the comforter to The Store and demanded a refund, which The Store properly refused as per its return policy. Additionally, when ****************** inquired as to the reason of your dissatisfaction, you advised that the comforter was defective as ti was leaking "feathers" and further, that you developed a rash from using it. Please note, none of The Store's employees noticed a rash on your body, nor did you provide photos of the alleged leakage.To add insult ot injury, on June 16, 2024, you left a defamatory review on The Stores website ni which you stated in sum and substance, that the store refused to accommodate you and to recoup the portion of the $2500 you paid. You also stated, amongst other things, that you spoke to **************** LAW GROUP, P.C. ***************************** Floor Licensed ni **************************************** T: ************ E: ********************* ******* "who was rude and also not helpful." This si simply false. ****************** was willing to make an exception for you and you chose to ignore it. What is worse, you took further action to file a frivolous complaint with the Better Business Bureau. Your complaint is baseless. You have engaged in intentional concerted conduct against our clients that can only be described as harassment and menacing. You have been very confrontational for no reason. There exists no space for your actions and behavior in our civil society.Your anger si out of control, and you have publicly ridiculed our clients' good name ni front of third parties. Your words directed at our clients lead us to believe that you may have violated laws preventing slander and libel.YOU ARE HEREBY COMMANDED TO IMMEDIATELY HEED OUR CLIENT'S DEMAND AND CEASE AND DESIST YOUR DEFAMATORY CONDUCT AND FROM HARASSING OUR CLIENTS.Should you fail to comply with the lawful demand of this office, and should we fail to receive a confirmation that you have retracted, and ceased and desisted from your unlawful actions against our clients, our clients will engage ni al appropriate legal process against you given your actions and hte trauma inflicted. nI that process, our clients wil seek al legal rights and remedies against you, and to recover al costs, plus interest provided by law, including, but not limited to, attorneys' fees and costs, disbursements, and punitive damages for intentional and wanton conduct.
