    On July 30, 2024, Austin ******** sent me what I thought was a proposal for publishing a book. I didnt know they were binding me into a binding contract, and I could not change my mind and use another publisher. Most publishers understand if the author changes his or her mind when a less expensive publisher makes an offer. But, they are still aggravating me about paying them $2900, even though I changed my mind and have already contracted with another publisher for $299. The issue is that I decided not to use them and they at no time informed me that the contract was binding and I HAD TO USE THEM NO MATTER WHAT! Last July, we were having inclement weather here and I had to pay for a roof replacement. I could not afford the offer and I still cannot afford it. They need to cancel the contract because I have moved on to a less expensive publisher. They have not tried to work with me and I cannot get this resolved.

    We are writing in reference to the complaint submitted by **** ******** ****** regarding their publishing agreement with Austin Macauley Publishers, signed on July 30, 2024. We respectfully refute the claims made and offer the following clarifications:
    The document executed and returned by the author on July 30, 2024, was a formal publishing contract, not a proposal. The title page of the document is clearly headed Publishing Contract, and its contents unambiguously set out the services, responsibilities, fees, and legal obligations binding both parties. The language of the document leave no room for misinterpretation. Therefore, the authors claim that the agreement was not a binding contract is rejected. Such a claim, made after voluntarily signing and submitting the document, does not appear to be made in good faith and is inconsistent with the clear terms of the agreement. A change of mind following acceptance does not constitute a valid reason for unilateral cancellation. Both parties are expected to fulfill their respective obligations under the contract unless otherwise mutually agreed.
    We understand the author has chosen to enter into a separate publishing arrangement with another company. However, this action constitutes a breach of the contract signed with us. Clause 1 of the agreement states:
    The AUTHOR warrants that there has been no granting of any interest in the copyright of the WORK, or part thereof, by license or otherwise to any person, or to any company or firm The AUTHOR grants to the PUBLISHER the sole right of the WORK to publish and to offer for sale and the sole right to negotiate in respect of Subsidiary Rights as set out in subsequent paragraphs.
    By granting rights to another publisher, the author has breached this clause and contravened the exclusivity granted to us under the contract.
    We fully understand the authors financial difficulties and would like to highlight that we have tried to accommodate their requests in good faith. The contract was signed in July ********************************** December 2024, we placed the title on hold to allow them flexibility. Despite receiving no payment towards the contract amount, our production department proceeded to house style the manuscript, assign designers, undertaking work in reliance on the authors contractual commitment. This work was carried out in good faith.

    In order to resolve this matter amicably and avoid protracted dispute, we are willing to cancel the contract without cost as a gesture of goodwill. This offer is made strictly without prejudice and despite the fact that we are under no legal obligation to do so. Our priority is to maintain professional standards.
    We maintain that the contract remains valid and enforceable. The authors actions and claims reflect a mischaracterization of the contract and the responsibilities it entails. Nevertheless, in the spirit of resolution, we hope the goodwill offer to cancel the contract can bring the matter to a close.

    I wrote a book per my contract the publisher was supposed to set up marketing and book signing events. I also was supposed to receive a check in December per my contract that says royalties are paid out in June and December. They have not marketed my book set up any book signing events. I tried to set up one and they never followed through with it. They never sent me a check. They have violated our contract and I want a refund.

As for my payment they said even though  my contract  states every six months it's standard  to wait 9 months. I'm not totally satisfied  and told them at this point  I want a refund.     Regarding the royalties, the terms are clearly outlined in the contract signed by both parties: "The PUBLISHER will render accounts of the WORK annually after the 31st of December, being after the first full year of publication, and by six-monthly transactions thereafter..." As such, the first royalty statement is due after the first full year, not after six months as the author has indicated.
    We have fulfilled all obligations as per the contract. Additionally, we will be arranging a meeting with the author to walk through the marketing and distribution efforts undertaken for the title. As a publisher, book sales are equally important to us, and we are committed to supporting the books success in the market.

    This company published my book after taking hundreds of dollars from me to do so. I have strong reason to believe they did not report all sales to me. When they discontinued my book Weak Love and Strong Love, they paid me only 1.12$ when even according to their reports the book sold about 10 copies and, according to ******, it had sold more. I have contacted them more than once about this. They ignored it. I am very mentally hurt by this.

As a publisher, we strive to provide every book with the best possible exposure through global distribution and marketing efforts. However, despite these efforts, when sales do not meet expectations, we sometimes have to make difficult decisions. Remaindering requires us to withdraw stock from distributors, destroy remaining copies, and discontinue further sales through our channels. This process also incurs costs, so we explore all options to continue supporting the book whenever possible.

    Additionally, we want to assure you that the royalty numbers reported to you are accurate, as they are directly fed from global distributors and platforms without any manual intervention. Please note that royalties are calculated based on the net price of the book, as all distributors receive trade discounts, which is standard practice in the industry. Moreover, once a book is purchased, the buyer has the right to resell it, and we have no control over its resale, as it becomes their property.


    Our intent was never to diminish the books value but rather to return the rights to you, allowing you the opportunity to explore alternative paths to keep the book available. We genuinely regret if this decision has caused any frustration.

    The money order were made on 4/05/23. The business misrepresented the contract by advising us that in advertising the work with Love without Borders they " would be looking into contacting book reviewers in the press and online sending out press releases to journalists, and submitting the books for awards and prices. Contacting individual store managers to stock the book, arranging usual interviews, and organizing guest blog posts on influential websites. ********** interviews with the media, Finding podcast interested in the work, covering online social media marketing and planning book signing." Because of their breach of contract I would like a full refund of the money. Due to misleading me & did not complying with what was said in the contract. I requested a refund but was ignored after many emails and phone calls I decided to reach out to BBB.

    The book was published in February 2024, and since the author is incarcerated the Power of Attorney requested to cancel and remainder the book in March 2024, citing concerns that marketing efforts were not being done. It is important to understand that marketing for any newly published book, especially for an emerging author, requires patience to produce measurable results.

    Despite the cancellation request within just one month, we had already distributed the book through most international distribution channels and pitched it to libraries, bookstores, press outlets, radio stations, bloggers, and reviewers, along with increased social media coverage. it is not always possible to show significant results within such a short timeframe, so we had a call with the Power of Attorney to discuss how we could jointly promote the book. 

    It is also important to note that our ability to fully execute the marketing plan has also been hindered by the fact that the book was self-published on Amazon and was not taken down by them, which violates our agreement. This breach has affected our efforts and the potential success of the marketing campaign, making them legally liable for this breach.

    We have upheld our end of the contract, fulfilled our obligations, and provided the agreed-upon services. The claim of a breach of contract on our part is unfounded, and the self-publication has further complicated our ability to deliver the full scope of our services.

Still we initiated extensive promotional activities. Importantly, the author breached the agreement by self-publishing the book on ****** without removing it, which has hampered our marketing efforts. The contract is already canceled, and we have nothing further to add.

    Our manuscript was submitted and approved before August of 2023 and any required payments were made in full by April of 2024.In January of 2024 we were asked to submit corrections to the ***** (being numbered pages in book format). We are now six months after that, and no corrections have been made. This follows resubmission of the same corrections delivered and acknowledged in January of this year.During the entire currency of this contract of now some ten months, only one call back to me was ever made. Today (June 25), their voice mail is full and not recording voice messages.

    Nearly two years ago I submitted a manuscript in book form to Austin Macauley Publishers that had been generated by my local printer,after they had shown interest in my work. They approved publication of my book. The original book that I had sent them measured 9 by 12 in soft covered form. I signed a contract with Austin Macauley and the process began. I soon learned that they would never answer their phones or return voice mails. I would pay $400 a month for 10 months for a hard cover production of my opus. During the process,I made some additions to my book entitled, Images of Infamy Second Sight,done. They made the necessary additions.In December of 2023, I received a copy of my book in the mail from Austin Macauley for my final approval. I signed off on the project as the copy they sent me measured on 8.5 by ************************************************************************** the printing process.The book was released on March 28. To my stunning surprise the complimentary books that were forwarded to me in mid April measured an astonishing 6 by 9. This represented 50 percent less square area than the original 9 by 12book they received to begin the project. I did not intend to pay $4000 to produce a soft covere pamphlet. During the last two years ,I had minimum contacts with Austin Macauley. I had spoken to their London based office and was assured that the size of my book would not be substantially altered.I was told today by the New *************** of ******** Affairs that I had agreed to the size of the format. Somewhere in the contract it appears that measurements in millimeters were used. I was assured verbally that it would not be an issue . I was the victim of *************** deceptive advertising. Now, the same complaint has been raised with the Better Business Bureau (BBB). We have also written an email to you to discuss and resolve this matter over the phone, but we have not received any acknowledgment. Therefore, we are reiterating our previous response.

    Upon reviewing the details of the complaint and our contractual obligations, we would like to clarify the provision of hardback complimentary copies to the author. As outlined in Clause 11 of the contract, we agreed to provide the author with specific complimentary copies, including posters, bookmarks, leaflets, and paperback copies of the work. However, there was no mention or agreement regarding the provision of hardback copies.

    Furthermore, the book size was agreed upon and documented in the Final Proof Certificate, which was signed by you. We have adhered to the specifications outlined in the Final Proof Certificate in the publication of the work. We already submitted the signed contract and Final Proof Certificate for reference.

    We take all complaints seriously and strive to resolve them in a fair and timely manner. Although this complaint lacks merit, we were willing to provide a resolution to you and regret that we have not received a response.

    I had signed a contract with Austin ******** *** 2019. Right from the beginning I have had problems it started with the coordinator of my book. The person ended up putting my book on the shelf and neglected it for months and months letting me know how much she disapproved in my book completely. She did not stop the process I kept pushing it it went to editing department it took them five times before I gave up in the book was still published with typos in the book. Then it went to marketing which I had at least four different groups of marketing people take my book send me one email and then never follow up or answer any of my emails. I had found out that my book at one time only sold dirty copies. Though my book went to letter bound within a year. None of this made sense at all. I get great ratings from my readers. I had continued to try to contact them over and over by telephone and by email and they do not respond. When I call them by phone they send me to a an extension that rings and rings and finally goes to an answer machine. Nobody follows up on it. I have found out through the internet that they had been charged with fraud. They had already with me had breached copyright laws by using my material on other people's books without my permission. And all this time I have been wanting to know what is the actual book sales number and I'd like to know where is my royalty check. I have not seen one dime of it. I'm supposed to have 25% across the board that even also includes books sold around the world. And yet I had not seen one *****. The last time I have had any contact with them was July 2023. I have sent emails to their ************* in ******* and got no response from that office either. I even sent one time and email to the third and final office of them in ************. And as the other offices I got no response. I paid $3,300 and I hadn't received only a box of books small posters and bookmarks with the picture of the cover on it. I have went out on media every site there is. I had marketed the book myself as best as one can. And they couldn't even keep the promise that was in the contract that my book would sit on shelves not electronic shelves that you have to have my personal hyperlink to get to it. my book ****** went on sale to other bookstores online and my book price has not depleted it has kept the price that originally was given when it was placed out on the market finally. I want to continue my career but I need to know the information of how many books I got and where is my royalty check. I also found out later with my daughter's help that all email messages get sent back to ******** and ****** does not answer any email coming from *******. Only the New *********** in ***************** is the only one anyone can talk to. And they will not answer emails from me or telephone calls.

    I signed a contract with Austin Macauley to publish my children's book. I have paid $2,290.00 towards the contract price of $2900.00. The company refuses to respond to my emails about edits and final payment. I last heard from the company on 6 February 2024. I have since sent an email on 20 and *************************************************************************** as the contact is voided. It is now 4 March 2024, and quite frankly I want nothing to do with such an unscrupulous business. I want to be clear that I wanted my book published. On the advice of *************************, a Production Coordinator with AM, I paid a $119.99 fee to an outside company so that I could send the illustrations for the book. I have not been provided with any explanation as to why AM has discontinued contact with me.

    Okay I am going to follow up in another complaint with the BBB because you're finally did not work nothing happened I have still yet to hear from Austin ******** I've still yet to get any of my money and I still get to have any resolution to my issues. They also will not have any contact with me they will not return emails that were not returning phone calls I need to have a lawyer because I am not getting any answer and I am owing money that I am not getting nor am I getting any reports of my sales on my books or any updates of what's going on. They also refuse to let me work go anywhere else and I had to show them my next book and turn them down before I can even go somewhere else because I was locked down in the contract when they didn't want anything to do with my first book after they started I have since fulfill the requirements I can go to someone else but now I'm having a hard time because they have ruin my reputation and no other publisher wants anything to do with me because I worked with them.

    Have been trying to get my contract terminated with Austin Macauley ad they have been in breach of contract and failed to market the book as they advertised and contract stated. My attorney also identifies that they are in breach of contract and we are trying this route to have publishing contract terminated and book rights returned back to myself.We have sent numerous inquiries requesting termination of contract for over a year and have met with zero response including certified letters and emails with zero response.

    We already contacted the author and find attached our correspondence. However the author is not responding to the email as the assertion he mentioned that he has been attempting to terminate the contract and has sent numerous inquiries and requests, was not true. We checked all our records, and have found no evidence of receiving any such correspondence from him, except for an email dated 06 February 2024, which was promptly forwarded to the relevant department for termination, and necessary steps were being taken to revert the rights to him. Since we were proceeding with the request, we have requested to withdraw the complaint.
