This business was hired to provide a service to dump our dumpster twice a month. For the months of January and February, our dumpster was only serviced once. 3 weeks passed between each service until we ultimately canceled service. The month of January was paid ahead and I paid half of the contracted amount for the month of February because they only provided half of a service. Technically I overpaid for January. I recieved a bill for $112 and some change and would like for that amount to be dropped as I have already overpaid for services not rendered.Business Response

Good Afternoon,
The customer was set up as an every other week pickup. It's understood that in order for our company to service the container we must be able to access it to dump it. This includes making sure the dumpster is not blocked and that the driveway is clear of ice and snow. Ensuring the driveway is clear of snow and ice is important is especially important as this driveway has a slope downward and the large heavy truck can get stuck very easily even with the proper winter tires. When our driver arrived on Monday January 22, 2024 the driveway was covered in snow and ice (picture enclosed). Consequently the pickup was skipped due to those conditions. The homeowner was notified that it was blocked and that we would try again at a later time. On January 25, 2024 we made another attempt to empty the dumpster and it was blocked by a ****** car (picture enclosed). The customer was notified of this and became irate with us. On 2/19/24 on this customers regular route we attempted to pick up the dumpster and the driveway was again covered in snow and ice. The dumpster was skipped for this reason. Not shortly after this failed attempt we spoke to this customer and it was decided that it was best to remove the container as they were unable to ensure that we could regularly pick up this container. Throughout this we ordeal, we offered the customer the option to switch to toters that could be taken to the road so we could removed the garbage on a regular schedule and the customer refused. We went over and above to work with this customer including multiple phone calls, sending trucks to their property multiple times outside of the scheduled route to empty the dumpster and also offering alternatives that would work to ensure regular garbage pickup and the customer refused.Customer Answer

The company admits they did not provide the service they were paid to do. We never had an issue with the old owners of this company. Their communication was great and they always got out within the same week to ensure we got what we were paying for.
As for our driveway, we cannot control the slope of the drive or when it snows. When we get lots of snow, we are able to plow with our tractor but cannot scrape a new stone drive for an inch of snow. We have two ways out of our driveway. The other side is always accessible and is not as steep.
On the day you showed up unannounced to attempt to pick up the dumpster, our ***** was blocking the dumpster. We do not have a ******. Had we known you would be there before the sun came up on that given day, we could've had the car moved, but we were not notified. On that day, I spoke to Kathy who said you would be out that day to dump it. After that phone call, the car was moved. She never informed me that you had already been there early that morning. The old owners never had any issues letting us know when the truck would be there. Honestly they never had an issue with snow either. For the almost 2 years we had them, if they needed to reschedule, they'd let me know a day.
I recieved a bill with a service charge for April. You guys are still billing me despite canceling your service. I'd like for you to stop sending me bills as I have already overpayed you for the service you didn't provide prior to cancelation. I dont care what the circumstances were, you did not service our dumpster twice a month for the months of January and February as hired to do. Instead you used poor communication on your part and the weather to warrant your laziness. You were paid in full for the month of January and I paid you half for February. If anything you owe me a refund for half of January because you only provided half of your service. Yet I'm continuing to get charged. I'm not even looking for money back, I just want you to get rid of what you think I owe you and leave me alone.
I have filed a complaint with the attorney generals office as well.

We stopped at the complainant’s property to provide the service we were hired to do. However, due to negligence of the client, the dumpster was either blocked or the driveway was inaccessible due to snow and ice and we were unable to provide the full service. I can’t think of a business that gives credits based on the client not fulfilling their part of the agreement. We incurred the cost of labor, fuel, wear and tear to our vehicles in our best attempt to empty the container. There are over 1200 customers that manage to keep their container clear and accessible during snow and ice conditions and not block the dumpster with a vehicle regardless of the exact type and yet somehow that’s impossible for some clients. We only have maybe one or two complaints a month and we have always provided proof of why their container was not picked up and most of them understand.
As far as the new ownership is concerned the ownership change happened in October of 2023 which was well before January. Yes, the previous owner came out many times after the stop was missed at their cost, that was their decision. We even came out an extra time to pick up the container at our cost and still couldn’t due to it being blocked. The client’s account is full of notes of blocked or inaccessible containers since May of 2022. This is not a new thing for this client.
Yes, a bill was sent with service charges for the unpaid portion of the payment. That is common practice of any business that has clients with past due bills.
As far as Ms. ****** claim that they would like to be left alone. Let it be known out that its Ms. **** that continues this. We did not file a claim with the Attorney General, we did not add additional comments to this post that required a response. At this point we only continue responding because we are required to. We have not called Ms. **** to collect on the balance. Yes, the account will continue to incur finance fees monthly but at this point if Ms. **** chooses to not continue this non sense no collections on that account are planned.
However, we have had enough, moving forward any additional responses will be handled by our lawyer and may be delayed as such. If Ms. **** would like to continue to leave inaccurate reviews on social media platforms our lawyers are ready to bring a lawsuit against Ms. **** personally as well as the LLC that was listed in the Attorney Generals filing for slander and libel. If this is brought to a court of law the back balance including all late fees and penalties, punitive damages incurred from the slander and libel also all associated lawyer and court fees will be requested as well. Let it be noted with the reviews on google, the comments on Facebook, this filing, the Attorney Generals filing, the full account notes dating back to when the client started service with our company, as well as the pictures providing proof that we attempted to service the property. There is more than enough evidence for a lawsuit. How we continue to move forward is up to Ms. ****.Initial Complaint

Despite taking monthly debited funds from my bank account they refuse to pick up the trash - this is literally their business - i have called for 5 weeks - they refuse to return calls - i spoke with the owner this morning - she advised me, “ if i come get my dumpster im dumping your trash on the ground first!” Yes she threatened me, my family and my property rather than provide the very service she is in business for!Business Response
