My 90 year old mother’s heat in her 09 *** stopped working. She asked my husband, **** and I to drop it off at PJ’s Radiator shop which is owned by Joe C*******. **** and I dropped it off at PJ’s on October 17th. The following day, my Mom received a call from PJ’s shop letting us know that her car is fixed and that we can pick it up. My Mom, who is hard of hearing, heard Joe say that her auto repair bill total is $400 and change. In succession, my Mom gave me 5 one-hundred dollar bills and asked **** and I to pick up her car and pay the repair bill. Upon arrival, I confirmed that there was 5 one-hundred dollar bills before handing the cash to **** so that he could go into the shop to pay the bill. **** handed Joe the money, collected the receipt and change, and then drove my Mom’s car home. Unfortunately, **** did not read the receipt before leaving Joe’s shop. Upon arriving at my Mom’s, I handed her the receipt and her change. At that point my Mom read her receipt and discovered that she had mis heard the cost of her repair bill which actually cost about $200 less than she thought. Then, my Mom counted her change and found that Joe had given her change for $300 instead of the $500 that was given to him. My mom immediately called Joe and told him she was short $200. He denied receiving $500 and claimed that he was looking at the $300 in cash on his desk right then. **** saw Joe put the cash in his desk drawer when he was there. The following morning, I immediately went back to Joe’s shop to ask Joe if he had found the extra $200 when balancing his drawer the prior evening. “No” was his answer. I responded by telling him that **** had handed him $500 and saw him put it in his drawer. This conflicts with Joe’s story that he told my Mom saying that the cash was still on his desk and that he was “counting” $300. I gave Joe my # and told him to call me if he found the missing $200. Joe replied that he wouldn’t find it and he had already checked.
