    I was sold ******************************* through Evergreen Agent LLC in the amount of $9800 on August 17, 2022. I was sold on the fact that if I did not make any money with the program, they would refund the $9800. I was verbally told I would need to follow the program and they guaranteed at least 2 sales within 6 months. If not, I would get my money back.Per the Origins Agreement page 3 Section 7. Terms of Sale: Evergreen Agent will refund the total program cost of $9800 if I do not close 2 deals within 6 months.I have been working with ******************* and ******************* at Evergreen Agent for 14 months now and have done everything they asked me to do.After 6 months of no sales and due to my ******** account getting shut down, I was no longer able to do marketing on ********. I spoke with ******************* and asked for my money back and that I am no longer able to advertise on ********. ***** sold me on the idea of marketing on ******* and ******* I agreed to give it a try and continue to work with Evergreen Agent.After months of all new training and coaching for the new marketing to home sellers as a listing agent, I was approved the next step in their program. The plan was to spend $600 per month on marketing that Evergreen Agent would set up for me. After getting everything set up and starting to get new leads I realize that they are marketing to home buyers and using ********. This is not at all what I had agreed to. They did not do any marketing on ******* or ****** and I was not getting leads for home sellers. After discussing again with *****, they changed the marketing to home sellers on ********. Getting frustrated with the process I just want to start getting some leads and some potential new clients. After spending another $1800 on marketing I still have no business and have now cancelled the marketing spend. So now, it has been 14 months since I signed on with Evergreen Agent and I still have not had any return on my investment, no clients, no closings, no deals! I have asked for a refund of the original $9800 and then silence. No response from them.I am asking for a full refund of $9800. Thank you for your time and consideration.

    We agreed to refund the total program cost under the conditions that you've met the terms and fulfilled your part of the agreement. We spoke about a year ago about how you did not qualify for the guarantee because you didn't do your part and yes, you weren't happy about it, but you acknowledged it and agreed. We were very clear on this before we started working together again.

    The second time around we started to work together, the original plan was to use ******* and ****** for lead generation but we pivoted. Before we launched on your Pre-Launch Demo we explained the shift to ******** and you agreed to move forward.

    We've generated dozens of leads for you. We've reviewed your dashboards where your marketing, as well as your sales data is tracked and found little to no sales activity on your part despite over 100 leads being generated for you.

    Client acquisition in real estate is the byproduct of both marketing and sales. Both elements must be working effectively to get the results. I do see in our records you made mentions of poor quality leads in some cases, however that's to be expected. We were very clear before lead generation began that not all leads will be the best quality and you will deal with some tire kickers, bad numbers, uninterested people, etc. as is the case with all lead generation.

    We tried to identify the constraints in the acquisition process but without the data from you, we're unable to do so.

    *****, I acknowledge that you have put in significant work after we agreed to continue working together beyond the original term, however the guarantee is not applicable to that. Your original agreement was for a 6 month term which you did not meet the conditions for a refund and thus, you were denied. We did agree to work together beyond that and provide a courtesy extension but the guarantee does not extend beyond that initial 6 month term. We're happy to find alternative resolutions, perhaps even explore that ************** route if you're willing to put up the ad spend for it.

    I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

    I did not get any business or close any deals within the first 6 months! As agreed in our contract, there would be a refund. The lack of business was due to my ******** account getting hacked. I am not able to use ******** for advertising. I was no longer able to access any of my accounts, and was blocked from ever using ******** advertising again. Evergreen Agent relies on ******** advertising. After explaining my situation Evergreen Agent agreed to help get leads through ****** and ******** (This never happened either). I believe that Evergreen Agent owes me a refund of $9800 due to them not being able generate business in the first 6 months or anytime after that. (I tried working with Evergreen Agent for 14 months before I quit). I keep jumping through hoops and spending more money and I have had nothing in return from my investment. I am not interested in working with Evergreen Agent. Please refund my money!
