When I signed up for the gym membership on 10/12/2024, I was informed that I was simply agreeing to a 12-month membership. I was not given the opportunity to review the full terms of the contract before signing, nor was I made aware that I could not cancel my membership at any time. This lack of transparency regarding the contractual obligations raises significant concerns. The "Entire Agreement" clause indicates that both parties must understand and agree to the terms before signing. The "Consumer Rights to Cancellation" clause states that I may cancel the contract within three days without penalty. However, since I was not provided the contract until today 10/17/2024, I was unable to exercise this right *************** theyre not letting me cancel my membership or get a full or even partial refund.

Customer signed agreement, made aware of the terms as he signed, and used the gym for a few days. I spoke with the customer to try to find a fair way out of the contract, but customer wanted money refunded that was not due to him as stated in terms of the contract.  Customer used the gym for several days and rescission was not valid. The gym is always willing to find a fair way out of a contract. Please see attached contract.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

I am writing to formally request a refund of my $277 and the termination of my contract. At the time of signing, I was not informed of the contract's terms nor given the opportunity to review it. I was led to believe that my signature solely acknowledged my payment for 12 months and nothing more, I was also never informed I didnt have the freedom to leave when I see fit. Which constitutes fraudulent misrepresentation.

I have only utilized the gym for two days and will be relocating to another state, making it impractical for me to continue with your facility. Additionally, I experienced significant delays in obtaining a response from your finance department.

I find it disheartening that a company of your stature would take advantage of individuals in ********** neighborhoods. If my request for a refund is denied, I would like the contract needed and require written confirmation of my contract termination.

The gym was used and contract was signed. The contract states no refunds. The only thing that can possibly be done is a shortening of membership.
