      I retained Wesley Clark and Peshkin regarding a custody matter at the beginning of this year. The first attorney I had at the firm took months to draft the initial custody petition and I had to correct the documents repeatedly. She also never represented me in the initial court appearance because she failed to submit an adjournment request early enough and couldn't attend the first appearance. The attorney left the firm and I was told a new attorney would be taking over my matter at the end of September and I wouldn't be charged to get her up to speed with my file. I also spoke to a Partner at the firm and explained my issues with the previous attorney who was no longer at the firm and was told they would give me a credit towards the $7,377.50 I had paid to the initial attorney to only have had only three total documents drafted.

      The new attorney and I met once and she and I seemed to have a better understanding and then I found out she had submitted an Order to Show Cause requesting to be removed as my council citing a breakdown in communication. She had sent me several emails over a three week period that somehow were sent directly to my junk email folder, even though we had emailed prior to those emails so I was unaware the emails were being sent to my spam folder. She never once tried to call or text, send a letter or use my alternate email address and simply filed to be relieved as my council. She never called to notify me of a court appearance until the day and actual time of the appearance so I had to talk to the judge by phone.

      The firm is now sending me invoices for another $2,676.75 when I never received any court appearance representation from them and have not received any additional petitions from the new attorney, who assured me I wouldn't be charged for her meeting with myself and the opposing counsel to get acquainted with the case. I don't feel I should have to pay them anything more for their gross misrepresentation of my matter.

      Sarah W***** - Lawyer * ****** ***** ******** *** *****. I selected my divorce lawyer due to her saying she was familiar with domestic violence situations and her experience regarding the issues around that matter, including how the other person tends to behave and act. She had me pay thousands to help with a restraining order but then never finished processing it so it was not effective the first year and a half and wouldn’t work whenever I called for my ex violating it. She also charged me $10,000 dollars and I did not get a resolution with the order of protection (which was a no contact order) and she also did not help regarding him cyber stalking or stalking me and did not get me a single dollar or help with the abusive situation. She helped him instead of me and didn’t even help me get the half of our 401k I’m legally entitled to. She did not do a single part of her job or fulfill her contractual obligation. She instead billed me for every text and question regarding him harassing me but did nothing to help stop the abusive behavior or help with the divorce.
      Desired Outcome:?I would like a full refund of my $10,000 dollars for zero contractual obligation filled and neglect of helping resolve the domestic violence situations or cyber stalking and harassment.

We see nothing in Ms. ******’ statement that is factual except for her reference to the standard practice of collecting fees and retainers for legal services.       Gave wcp 3500 dollar retainer in May 2022 fired wcp in July 2022 they returned 191.50 in July Total charged 3308.50. I spoke to Mr. C**** about handling my case prior to leaving my retainer he said he would be handling my case, when I dropped my retainer check I was informed after giving them my check that Said A****** would be handling my divorce.I felt I had been bait and switched and had second thoughts but left without asking for my check back. Finding out later that Mr. C**** who gave me my phone consultation doesnt even work out of Albany location. Said did a horrible job and just wanted to go along with my wife and her lawyer he had to be fired then they juiced up a bill taking almost all my retainer and refunding very little. He did very little work on my behalf and took a lot of money for it not to mention the work he did was terrible and only benefited my wife who has a good very aggressive attorney and very competent.

We would like to address two points that were made in the complaint.  The first being that our Managing Partner, Kevin C****, does work and serves clients across New York State. As do many of our attorneys and many attorneys at other firms and in a variety of areas of law.  It’s a common and accepted practice.  Also common, is for a partner to do the initial consult, assess the case and often assign to another attorney who might be best suited to handle a particular matter. This is not a bait-and-switch tactic, but rather a process that is intended to best serve the client. If Mr. ********* feels that his assigned Attorney, Mr. I******, did not serve him adequately, we would, again, be willing to discuss that directly.
