  05/14/24 We were scheduled for a resealing with them. They left us a message to ensure all vehicles were moved which we did the night before. The problem was they had not shown up to complete work, but we received an invoice to pay around 12:30. My wife called about the invoice and told them no work had been completed. After we stated that we would not pay until the job was completed, she informed my wife that there was weather coming in and they would not get to us today and that we were on a list to be canceled. It is now 17:16 and no rain. Not sure if this was a scam, overbooking, mismanagement. Customer service was poor, we explained that we could not just change dates with my wife going through radiation treatments.

  You and ***** have been our customers for a few years. Since 2020 in fact. I am sorry that we had a weather concern that day. To protect pur customers we have to be careful of there is a chance of rain. It is unfortunate as sometimes we don't know until the end of the day if we have to wait to do certain jobs. You are not the only customer that we had to delay that day. It did intact rain in many areas. When we seal and it rains right after it can wash the application away. Worse it can splash up on sidewalks, garages etc and cause a mess. We were not willing ro take that chance that day with anyone's property. I see you are on Lambert Street and in a Community we service just about everyday. I am sorry to hear ***** is going through radiation. I see my team tried to give you a new Dat and you refused. Our invoices are automated and they go out when the system sees the schedule date. By no means would you have been required to pay for the service until it was completed. I would think that after being with is since 2020 you would understand and know that. We do appreciate your business and sympathize with what you both are enduring right now. If you change your mind and want to be added back to the schedule just let us know. If I could contract Mother Nature I 100% would but unfortunately I can't. The daily tempature and dew point also matters when we apply sealer. We have to take all of it into consideration on a daily basis. God Bless and healing prayers for ***** and strength for you both.

  I have been using Western NY Sealing & Paving for about 15 years to seal my driveway. They have always done a good job. Now I’m very disappointed in them because they refuse to honor a signed & dated contract with theirs & mine signature on it. They say they have a email that shows a higher price to tear out & put in a new driveway. I would think a signed contract would hold up better in a court of law! They refuse to lower their price & are returning my $600 deposit.

  I have spoken with you on multiple occasions. I am personally the rep that came and did your estimate and sent your quotes. My professional opinion was to tear out your driveway due to the condition of it. I sent you a quote first for the tear out and replacement which was $7800.00. You and I spoke on the phone and you explained you could not justify that cost and could I top coat the driveway. I explained that I could but it would take an additional 3-4 tons to shim all settled and sinking areas. That cost was for $6,100. You then explained you needed to be at $6000.00 so as a courtesy I discounted it another $100.00 to get you to $6000.00 to do a resurface. I am sorry you are confused about the 2 different types of jobs. We can not afford or justify doing a complete tear out for $6000.00 I also emailed you a breakdown of exactly what we would have to pay for all material and labor to prep and then fill your driveway. We in fact had you scheduled to do your top coat on Friday 5/17 but you then declined and said you wanted a tear out. You also explained you had other competitor quotes that were lower to do the job you would like. That is completely fine and if someone else is able to do it at a better cost than us, I encourage you to do so. The contract signed is for a top coat. You are reading a description of work that pertained to the first quote of doing a tear out for $7800.00. We have appreciated your business as we sealed over the years. It is upsetting to us as well that you are not understanding. In order for us to survive as a business we can not pave driveways that we pay put of pocket for. I am sorry. I returned your deposit and cancelled your job so that you can pursue the work with a different vendor. The contract you have is really to protect us form those that may not pay for services timely. The contract for you is so that you have the warranty on the job for 1-2 years after install. No work was done on your property. There is no contract as we have cancelled the job. We wish you well and do hope your able to get the services you need at the price you need it to be.
