    Hello my car has been sitting on this lot for over a year throughout this time I have been being told that they are still waiting on parts because of the shortage that we’re having with all of the car thefts and other things. I live about a mile and a half away from the shop. I drove by and saw that my car was gone and was told that it was considered abandoned without a phone call or any information I am now until that I must be charge. Storage fees is Well although we were in communication throughout this time, they told me that they lost my number and had no way to get in contact with me. Please help.

    Like you have stated in your complaint, the vehicle was on our lot for over a year. We did send a registered letter to the owner of the vehicle informing of  NOTICE OF SALE AND CLAIM OF LIEN. Per NYS DMV the only information we had on file was the last known owner. We did not receive any authorization to work on the vehicle and no parts were ordered. Towing and storage fees ($40/day) will need to be paid in order to regain possession of the vehicle.

    Response taken by phone:  I was given quotes and gave them authorization for them to fix it.  I understood that it might take a while to get parts.  Then they kept coming up with excuses and claimed they lost my information.  Now they are claiming I need to pay towing and storage for a whole year.   This was their doing.  I've done business with them before and never had any problems.  I need to know a reasonable amount so I can get the car out of there.

    There was never an agreement or any signed paperwork for an estimate or a repair plan for the vehicle. We did not have information to contact you since we moved to a new system, the only way to reach out was per the DMV and a resisted letter sent to the owner of the vehicle (unfortunately since the vehicle was not in your name, and did not know that till our final phone conversation) That letter was sent to **** *** ********. Per dmv since technically that is the true owner of the vehicle that is the only information provided.  An unclaimed vehicle is a motor vehicle, other than an impounded vehicle, that is being held by an automotive-related business and that may be lawfully released by the business to the customer upon payment for the reasonable charges for repairs, towing, and/or storage, as applicable. If an automotive-related business tows or stores an abandoned vehicle at the request of a police officer, and the local authority does not choose to exercise its right to take custody and ownership of the vehicle as prescribed by §1224 of the New York State Vehicle and Traffic Law, then such motor vehicle will be considered an unclaimed vehicle.
