********************************* operates as a towing company contracted by ******************** Selden for parking enforcement. Their responsibility is to remove vehicles only when authorized by property management and to follow proper legal procedures regarding documentation and notification.Nature of the Dispute:My vehicle, a 2015 ******* Elantra (VIN: ****************** ** ****** *******), was unlawfully towed from ******************** Selden on February 4, 2025, at 9:55 PM, without specific authorization from property management.I spoke directly with ******* ******, the property manager, who confirmed that he did NOT request the tow, even though he is the only authorized individual to do so.Midnight Towing appears to be patrolling and towing vehicles at their own discretion, which is an unauthorized practice that constitutes predatory towing. The company failed to provide proof of authorization, photographic evidence, or documentation supporting the tow.The company operates on a "cash-only" basis, refusing to accept legally required payment methods, raising concerns regarding financial misconduct and potential tax violations.Efforts to Resolve the Problem:I personally went to ********************************* to request the immediate release of my vehicle, but they refused.I contacted the police, who stated that this is a civil matter and did not intervene.I have made multiple attempts to discuss this issue with property management and the tow yard, but they have not taken steps to resolve the issue.Additional Information:I am aware that this is not an isolated incidentMidnight Towing has engaged in similar predatory towing practices at other apartment complexes, including Coram apartments.I am submitting this complaint to request an investigation into the companys practices, a refund for the unlawful towing fees, and to hold the company accountable for their illegal business operations.

    Business Response

Hello, I will be responding to this loss of everyone time. yes, we understand that the BBB is here to help with the consumer, but this is abuse of the keyboard. Yes, we tow the car from the fire zone and the issue with this property is that if you are parked in the road way a fire truck cannot pass nor can an ambulance. The tenants of this complex have been notified of these many times, plus it is in their lease. As you can see in the photos that I include it is posted that you cannot park in the street, or you will be towed. He did come to our office with papers he said were from a Lawyer for us to discover that they were all fake as per our Lawyer. After he call the police, they showed up and we provided they with all the information for them to tell him he has to pay and that we followed all Protocol with towing and logging the car out at the police station. we left off that he would come back into the office to discuss the matter with me but never returned. As for **** speaking with ******* ******* he did call him but never said his car was towed and all he did was ask him if we were the company that handles the towing In which he responded with yes, you are more than welcome the reach out to him for a statement his number is ************. When he did come back to pick up the car I did ask if he was a resident and he replied yes so, we did not charge him the additional days of storage and told him what the fees would be and instructed him that for impounds it has to be paid in cash only unfortunately  we don't take a credit card with impounds because of the charges backs but in my defense the state impounds, police impounds and town impounds only take cash as a payment for this reason also. As for he to mention other apartment complexes we service many with posted fire zones and was not under the understanding he was not an expert in the roadways and layout of all the complexes. With all this being said if there is anything more I can help you with this matter it would be a pleasure, Just give me a call ************

P.S. We are currently filing a lawsuit for defamation of character and are responding to the one he filed against Midnight Towing inc.

    Thank You for your time,

    ********* ******
