DC Home Repairs, Inc., Owner Richard (D*****) ***** of **** ****** ***** ************ ** *****, was hired for roofing work at my house on *** ******* ***** *************** **. Mr. ***** required a $20,000.00 cash deposit which I paid to him on July 5, 2023. On or about July 18, 2023, I observed two Guatemalan men, a woman and a young man working on my garage roof. Mr. ***** stated he could not work on the main house roof because he could not find 18 foot boards at any lumber yard. I went to a local Amish sawmill and ordered the 18 foot lumber. I set up a date for Mr. ***** to pick up the lumber but he never picked them up. Around that time, I went to the property and found that the singles were not put up correctly and the workmanship was very poor. I noticed there was no flashing where the garage meets the house and I noticed sunshine pouring into the garage. I also noticed burn mark holes in the open flame torch down part of the roof that were letting water in. I asked Mr. ***** to stop work until I could meet with an architect about the repairs. The architect stated that I should stop all work with DC Home Repairs, Inc. I met with Mr. ***** where he screamed and yelled at me that he was going to rip the roof off as I pointed out all the mistakes and found out he has 1) NO WORKERS' COMP INS. 2) HE VIOLATED NYS LAW as he did not deposit my funds into an escrow account 3)Would not show me his liability ins documents including open flame torch down rider 4) Did not apply or receive a Town Building Permit as he said he would. I believe he has been Scheming to Defraud me all along as his workers do not even know how to put on a simple shingled garage roof much less re-frame my main roof structure and apply rubber roofing. This explains his delay, saying he could not find lumber. This is Grand Larceny. Please BBB, help me to get my $20,000.00 deposit back so I can move on and hire someone else. Pls investigate if DC Home Repairs, Inc. is a legitimate business.

    Business Response

    Date: 09/29/2023

I received a letter from the Better Business Bureau on 9/23/2023 in regards to ********* ****** # ******** in wich case I am responding via written letter.  miss ****** was referred to me by a friend looking to get repairs done to a building that her son/she purchased that had been vacant and dilaputated for many years and had substantial damage.  I told her because she know my friend (I found out later she didn't know him) I could do the work for around $40,000.  $20,000 down via check, she said she prefer cash transaction because her business (***** ******) has a lot of "off the books intake" so I said fine.  Being I am a small business owner and don't have employees I subbed the roofing area of the work scope to a gentleman who I've had contact with on other job sites prior to this matter, in which case I have tried to contact him to no avail.  The man was Ecuadorian, not Guatemalan.  We were initially supposed to the do the garage roof, main house roof and some soffett and fascia work.  After looking at the main damaged area more thoroughly, I requested to make sure they had workers comp because it was more dangerous than expected.  I haven't heard from them since.  Miss ****** contacted me at one point and said she wanted to stop work on the project to get an engineers opinion I said ok call me when your ready.  Roughly two weeks later she calls and I went to the property running late to be rudely greeted by her and this architect/engineer who proceeded to be verbally aggressive and rude to the point that I finally said I had enough and left telling Ms. ****** to contact me when she was ready to be more professional.  She replied "you don't have to come back just drop my 20k off at the pizza shop.  Materials were purchased, labor, and extra work outside the origonal scope was done and I told her I did not want to work for someone so rude and misleading and I would refund her the remaining balance from the 20k to $7,500.  I kept all the texts receipts for materials and labor.  I explained this to her and she asked me to give her 10k back and we would go separate ways.  This is the first time I've ever had a problem with "ANYONE" and very unfair for somebody who has had a cash business to try and take advantage of someone who is an honest hardworking small business owner.  She has also held personal property of mine hostage and tried to file charges to try and bully me around.  If she had any concerns while the job was going on she should have expressed them.  and we could have addressed all concerns immediately.  She did not, nor did she ask for any documentation of any sort!  Thank you for taking the time to read this response.  If you have any questions, feel free to contact me.

    Customer Answer

    Date: 10/02/2023

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.
I, ********* ******, entered into a legally binding contract with DC Home Repairs, Inc. owner Richard ***** on July 5, 2023 for a total of $41.885.00 and I paid him his required certified US funds deposit of $20,000.00 for roofing and repair work.  Under this agreement, it was agreed that this contract deposit of $20,000.00 would be held in an escrow account at a financial institution as per NYS Law.  I have since learned this escrow account was never established. Upon signing the contract, I requested copies of all documents for Workers' Compensation Insurance for Mr. *****, his employees, including his nephew who regularly works for him, and any subcontractors, along with liability insurance with an open flame torch down roofing rider, naming me as co-insured, be forwarded to me.  This was never done. The new roofing shingle work that was performed must be removed and replaced due to severe inadequacy in quality, labor and workmanship of roofing material installation.  The garage roof has severe deficiencies in application.  Mr. ***** agreed to this fact when we reviewed the job on location on Monday, August 14, 2023.  I have a catalogue of pictures before, during and after work was halted, documenting the substandard work. On the advice of my professional construction manager stating the work that was started was severely substandard on quality, a decision was made to stop work to further review and clarify the contract.  DC Home Repairs, Inc. had worked for only two days at this time and it was very evident their workmanship was terrible. Through my research of DC Home Repairs, Inc. on the web and on *********************** *******, it appears there is no business on record found with this name.  Additionally, Mr. *****' phone number reveals it is not in his name and not in DC Home Repairs, Inc. name, but in someone entirely different. DC Home Repairs, Inc. owner Richard *****, was hired for performance of repair work to a *** **** ******* ******** ******** ****, located in the Town of Florida, Montgomery County, with architectural Italianate design. Due to the severe incapability of workmanship, a full refund is warranted. Thank you, BBB, for all your help in this action. Sincerely,
    ********* ******
