    This title search company did not complete an adequate search of debts owed on my property before closing date. Subsequent to the closing, my homeowners association advised me of unpaid homeowners dues from the previous homeowner. I have contacted Schowright but they refuse to talk with me and the homeowners association who have also tried speaking with Schowright. Schowright owes me this money as they guarantee a clean title at closing since this debt must be paid by me now.

    Schowright Abstract Corp. does a diligent search of the public record against the individual and the subject  property , ie. *** ****** *** **. , Town of Jefferson , County of Schoharie. The seller of the property , Mr. ****** , was aware of  the delinquent HOA assessments but did not disclose this.  The ******* ****** **** *********** did NOT file any Judgment or Transcript of Judgment in the Town or County Courts. We are not responsible for debts or assessments that are not filed and recorded in the Schoharie County Clerk’s Office……

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. 

    The ******* ****** **** ********** *********** (****) dues are a lawful requirement as per the deed of the property.  Requesting an invoice, letter or statement from the homeowners association would be the proof that the homeowners association dues were paid in full.  This is the real estate procedure.  Schowright took the word of the property owner that his dues were paid in full when in fact they were not paid.  Schowright did not complete this part of the clear title as per the insurance policy given at closing.  Schowright's negligence is the reason for the claim.  Again, The seller Mr. ****** did not disclose his unpaid dues which is why documentation should have been requested from **** showing his dues were or were not paid.  Word of mouth from the seller is not sufficient.  Documentation in the form of an invoice, letter or statement supporting his claim should have been obtained.  It was not.  I am requesting that the title insurance policy that Schowright provided during closing be enforced and utilized to pay the debt of the previous homeowner as requested.  I have made communication with them in the form of letters and phone calls but they do not respond to my inquiries.  I am requesting the the title insurance policy be beheld.  Regards,
