    I was introduced to Tyler Kelly (TK Landscapes) through *******, a landscaping design company. ******* designed the front yard and gave the design to TK Landscapes. Mr. Kelly was supposed to landscape my entire front yard, including lights and flowers, and making a walkway from the driveway to the house, and the house to the road. After meeting with him in May 2022, he planned to subcontract out the walkway portion and do the lights and flowers portion himself. He said he would "get the job done next month."
    As of August 2022, he still had not started, and told us he needed money up front to get supplies, etc. He charged my credit card $6,757.50 on August 12, 2022.
    Over the next year, we had 2 other meetings with him, and numerous emails back and forth, and he never did any of the landscaping. Several times, he blamed it on different supposed subcontractors (for the walkway), but did not allow us to contact them directly.
    Starting 11/2022, we began requesting that he either start our job or give us a refund of our money. He kept telling us he was going to start the job soon, but did not. In June 2023, he gave us a start date of July 10,2023, saying the job would get done that week, and he never showed up or returned our texts or calls after that.
    Since that time, the ******* company has attempted to get TK Landscapes to refund all our money, and he has sent a check for only $5,000, stating he WILL NOT refund the balance, $1,757.50, even though no landscaping has been done.

    Please review the attached document outlining in detail the identified scope of work, the concerns, work left undone and amounts paid. Tklandscapes failed to complete the job hired to complete, along with not refunding homeowner for materials that were not purchased. Tyler K**** has stopped communication with homeowner and has refused to even engage in a conversation to resolve this complaint. Thousands of dollars have been left unaccounted for.     I paid a deposit ($351) on June 28 that was half of the quoted price to do some yard work. The work was never started or completed. My deposit has yet to be refunded after repeated requests.

    We have tried to contact TK Landscapes for the past month to resolve this issue, but have not received any call backs.

    The job was quoted on 7/14/2022 for $3300 to perform the following work: removals of current landscape, installation of fabric, new plants and stone.

    We sent a deposit of $1685 to lock us into his schedule on 7/29/2022. The Invoice number #393 listed the following on it:

    Bushes $950
    Fabric $320
    Stone $400
    Labor $1700

    The invoice totaled $3370, $70 higher than the original quote.

    The work was started for one day on the week of 8/15/2022.

    Progress on our project has been minimal with no schedule provided. We contacted Tyler many times with little to no responses. When he did respond he stated that he would be starting back up next week and he did not show.

    We inquired about parting ways and getting a refund less the work that was completed.

    His response was that only $300 of the $1685 deposit could be refunded. He stated that “the down payment doesn’t just include material it also includes partial labor.” He also said “everything was ripped out and hauled away.”

    We did not receive any items that might have been purchased for our job and are unaware if anything was purchase as nothing was delivered to our house.

    There was labor applied to the project, he had one of his workers show up for 2 partial days to remove the block borders and some of the bushes and shrubs. There are still many bushes and shrubs, stumps and root systems that have not been removed. Someone did come and pick up some of the shrubs after the first day’s work, but all the blocks were left in our driveway and lawn, we had to have them removed.
