    In December of 2022 our neighbor had a fire in his garage, which resulted in the siding on our house melting. We contacted several Contractors and Josh Bartle from JB Construction in Syracuse NY called and made an appointment to come to the house to view the damage. We also showed him the door the fireman had to break to get into our house that day, and talked about a safety fence in the back yard. He came up with an estimate for all 3 projects of $6100 and on 1/1/23 he stopped by and we signed a Contract. He asked that we give him 75% down in 3 separate checks for the 3 projects. The total amount of the checks came to $4575. Again this was on 1/1/23, and to date (6/5/23) no work at all has been done on any of the projects we agreed to. I was in contact with him by text right from the start with questions on the projects. But still no one ever showed up to do any work. In February he said he was in Florida working, and would be coming back to NY soon. I contacted him again in March, and he told me he would be up shortly to get our work done, claiming "No worries with my company." But still April came and no one called, or showed up. In May I saw a disturbing comment online, under the Better Business Bureau, about his company. A man complained, in March of this year, that he paid JB Construction $3500 for work and nothing was ever done. The man claimed he had a signed Contract, and gave Josh cash. Josh responded in the write up that he would never take Cash and the man was not telling the whole truth about the agreement. On 5/11/23 I copied the online comment and sent it to Josh by text saying "Oh Josh, please don't tell me I'm going to have a problem. I truly trusted you." - No Response. Then again on 5/23/23 I sent another text, this time telling Josh I was advised to ask for the return of my down payment, since obviously he was not going to honor the Contract we signed. Again, to date there has been no response. Thank you - ** ******

    On January 3, 2023 I met with Joshua B***** of J-B Construction about a tub and tile job for my rental property. We both agreed to the proposal and signed the contract, which we both have copies of. I paid him $3500 cash to move forward on ordering materials, which he accepted. He said he would let me know when the order was in so we could schedule a start date so I could notify my tenants. After a few days of texting back and fourth on the status of the materials he claimed he ordered, on Monday June 9th he stated 3/4 of the order was ready and it would be another day and that he would call in the morning. No call came Tuesday. I reached out Wednesday the 11th and no reply. Again I reached out Thursday the 12th and no reply. On Friday I called the police and he finally sent me a message that his phone broke and had to wait for a new one in the mail. I sent him a letter stating I no longer trust his ability to perform the work per our agreement. I stated I would gladly cover the cost of all materials ordered (with proof of dated store receipts), I offered him $200 for his time and efforts and asked for a refund of the difference from my $3500 cash to be paid in cash or certified funds back to me. He is now claiming there was never a signed contract, that no money was exchanged and that he called and canceled the tub. He claims he cannot accept cash as payment per IRS and State laws and that he asked for a check which is false. He never asked for a check. He also went on to say if I have any further contact to him he will consider that harassment and threatened to file charges against me. I have text records of all conversations exchanged regarding this matter. He is a thief and a liar and I don’t trust him on my property for the safety of my tenants and my property. At this time I am looking for a full refund of $3500.

    I sent the client a contract via text for him to review and sign, he did not..  So we met in person and I handed him the contract. He wanted to pay me in cash and I declined it as I require a check written out to my company. He didn't have his check book with him. I told him to reach back out to me when the contract is signed and a check is available.. I told the client I would reserve materials for him at a cheaper price but needed to be paid for before I could pick them up which is why I was waiting on a check from the client. The client obviously wants free work or money and I will not tolerate such! No contract was signed, no money was exchanged!

    I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.


    Copy of accepted proposal - including $3500 agreed deposit and signed and accepted by all parties attached for review.  Also, attached are copies of text messages proving all conversation of the $3500 deposit was to be paid by me in cash.  I never had a refusal for cash or a request asking for a check by Mr. B*****.

    As I stated before, I have all of the text messages as well. He does agree to the quote I gave him but no agreement was said for cash! I did not text him and agree to cash! I would like him to provide a copy of the Yellow Carbon Copy and the Pink Copy also! I feel he signed this recently and used an older dateto try and better his case. Before I brought him the contract, I took pictures of all 3 copies! So please provide that! However, I will not give in and tolerate him wanting free work/money. I have delta with customers like him before!
